HomeMy Public PortalAboutFeb 10 BOH MinutesBOARD OF HEALTH MEETING February 17, 2010 Town Council Chambers, Administration Building CALL TO ORDER: Dr. Straus called the meeting to order at 7:40 PM. PRESENT: Dr. John Straus, Cynthia Brooks, Steven Ward, Kristel Bennett, and Karen O'Reilly. Minute Review: The Board of Health reviewed the minutes of the January 13, 2010 meeting. Cynthia Brooks made a motion to accept the minutes of January 13, 2010 meeting. Dr. Straus seconded the motion. All were in favor. District 2 Presentation: Animal Control Officer, Karen O'Reilly presented the January 2010 Environmental and Community Health Report to the Board. Ms. O'Reilly discussed ongoing animal control cases she is working on, the geese management program, the upcoming rabies clinic in April, the Dangerous Dog Hearing, and possible kennel regulations. D & D Pizza Subs: Kristel Bennett presented the plan review documentation for D & D Pizza — Subs located at 135 Mt Auburn Street. Mrs. Bennett informed the Board that the owner, Peter Theofilopoulos was requesting a 2010 Food Service Establishment Permit. Mrs. Bennett informed the Board that the applicant had completed the Person In Charge Training, has been instructed as to their responsibility regarding the requirements of the Food Code, and has been instructed as to their responsibility concerning the inspection process. Mrs. Bennett also informed the Board of the administrative actions taken with D & D Pizza — Subs for failure to comply with violations listed in an inspection report. The violations include the following: storing raw animal product over ready to eat food, thawing potentially hazardous food at room temperature — not following approved thawing methods, and wet wiping cloths on countertops --- not storing wet wiping cloths in sanitizing solution. After a brief discussion the Cynthia Brooks Board of Health Minutes February 17, 2010 made a motion to extend the Temporary Food Service Permit of D 7 D Pizza Subs located at 135 Mt Auburn Street for three months. During this period an inspection will be conducted on a monthly basis to ensure compliance with the State Sanitary Code 105 CMR 590.000. Should further violations occur of the State Sanitary Code 105 CMR 590.000 occur the Board of Health may suspend or revoke D & D Pizza — Sub's permit to operate a food service establishment. Dr. Straus seconded the motion. All were in favor. 28 Howard Street: Kristel Bennett informed the Board that Franco Zeppa owner of 28 Howard Street and George Righellis of Righellis Oil were requesting a hearing before the Board for modification on compliance time for the order letter dated January 22, 2010. Mrs. Bennett presented the findings of sanitarian, Mark Waksmonski's inspection report and noted one violation was remaining. Mr. George Righellis informed the Board about the efforts to remedy the violations, and that all violations had been abated. After much discussion thereof Cynthia Brooks made a motion to amend the order letter dated January 22, 2010 to extend the requirements of compliance time to February 24, 2010. An inspection will occur before February 24, 2010, if the violations remain unabated by February 24, 2010 a court complaint will be filed against the owner of 28 Howard Street in Waltham District Court. Dr. Straus seconded the motion. All were in favor. A & M Variety: Kristel Bennett informed the Board that A & M variety was before the Board for a show cause hearing for a second violation of the Regulations of the Watertown Board of Health Sale of tobacco Products to Minors. Mario Pulecio, owner of A 7 M Variety presented findings to the Board of Health. Mrs. Bennett presented the findings of the January 14, 2010 tobacco compliance check. After much discussion thereof, Cynthia Brooks made a motion that acting under the authority of the "Regulations of the Watertown Board of Health Sales of Tobacco Products to Minors" regulations J (1) (b) "Violations", the Board of Health suspend the Tobacco Sales and Location permit for A & M Variety located at 385 Arsenal Street, Watertown, for seven (7) days commencing on Thursday, February 18, 2010. Furtheiiiiore, all employees associated with the sales of tobacco products shall attend a mandatory Tobacco Retailer Training provided by the Watertown Health Department on Monday, February 22, 2010 2 Board of Health Minutes February 17, 2010 at 10:00 AM. For the duration of the suspension, all tobacco products shall be locked, secured, and covered not accessible to the public, only to employees. Dr. Straus seconded the motion. All were in favor. 100 Dexter Avenue: Kristel Bennett informed the Board that the owners of 100 Dexter Avenue, Arthur and Mary Papazian were requesting a hearing before the Board for modification of compliance time for the order letter dated January 26, 2010. Mrs. Bennett presented the findings of sanitarian, Cathleen Liberty's inspection report and noted violations still remain, but it appeared progress had been made to address the violations. Mr. A. Joseph Papazian (son of owners) informed the Board about the efforts to remedy the violations listed in the order letter. After much discussion thereof, Cynthia Brooks made a motion to amend the order letter dated January 26, 2010 to extend the requirements of compliance time to March 17, 2010, the next Board of Health meeting. Dr. Straus seconded the motion. All were in favor. 411 A Mt Auburn Street: Kristel Bennett informed the Board that Krikor and Ann Keikian owners of 411 A Mt Auburn Street requested a hearing before the Board for modification on compliance time for the order letter dated January 14, 2010. Mrs. Bennett presented the findings of sanitarian, Cathleen Liberty's inspection report and noted the remaining violations. The Board noted the owner requested a hearing, but failed to appear. After much discussion thereof Cynthia Brooks made a motion to amend the order letter dated January 14, 2010 to extend the requirements of compliance time to February 24, 2010. An inspection will occur before February 24, 2010, if the violations remain unabated by February 24, 2010 a court complaint will be filed against the owner of 411 A Mt Auburn Street in Waltham District Court. Dr. Straus seconded the motion. All were in favor. 41 Quincy Avenue: Kristel Bennett updated the Board with the status at 41 Quincy Avenue and the outstanding sanitary code violations against, Paul Zakszewski. After hearing the findings of Mrs. Bennett's inspection report and after much discussion Cynthia Brooks made a motion, to ratify the condemnation order of December 23, 2009. 3 Board of Health Minutes February 17, 2010 In addition the Board of Health requires the owners of the property to provide a written plan for accessing the dwelling to remove valuable, and to either correct the violations listed in the Order to Correct letter dated December 23, 2009 or to provide an alternative to demolition of the dwelling.
