AWARD OF PROFESSIONAL SERVICES CONTRACT FOR
M~GIN~RING SERVIO~
WHEREAS, there exists a need for professional services to provide
gnEineering Services in cormection with the Borough's Infiltration and
Infl~ Reduction Progr~n; servle~ shall include Smoke Testing, Test
Analysis and Report of Findings ; 'and
WHEREAS, pursuant to N.J.S.A. 40A:ll-5(1)(a) professional services are
exempt from the requirements of co~q~etitive bidding; and
WHEREAS, the local Finance Officer has certified that funds are available.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough
of Carteret does hereby approve the appointment of Kill,an and
Associates at a maximum cost of not to exceed$2%000.OO
billable per attached contract.
BE IT FURRItER RESOLVED, that the Mayor and Municipal Clerk are hereby
authorized to execute said contract.
IT IS FURIHER RESOLVED, that the contract is awarded without competitive
bids in accordance with N.J.S.A. 40A:ll-5(1)(a) due to the specialized
and professional nature of the services provided.

As per Resolution Number 00-182.
THE CONTRACTOR does hereby agree to perform the following
PROFESSIONAL SERVICE TO PROVIDE ENGINEERiNG SERVICES IN
CONNECTION WITH THE BOROUGH'S INFILTRATION AND iNFLOW
REDUCTION PROGRAM; SERVICE SHALL INCLUDE SMOKE TESTING, TEST
ANALYSIS AND REPORT OF FINDINGS.
NOT TO EXCEED $25,000.00
According to the terms set forth in Resolution.
THE INDEMNIFICATION AGREEMENT ON
THE REVERSE OF THE PURCHASE ORDER
SHALL BE LIMITED TO THE VENDOR'S
NEGLIGENT OR WRONGFUL ACTS.
THE BOROUGH does hereby agree to pay the Contractor the sum set
forth in Resolution.
IN WITNESS WHEREOF, the parties hereto have hereunder set their hands and seals or
caused these presents to be signed by their proper corporate officers and their corporate
seals to be hereto affixed, the day and year written above.
