CALL TO ORDER: Dr. John Straus called the meeting to order at 7:40 PM.
PRESENT: Dr. John Straus, Dr. Barbara Beck, Cynthia Brooks, Steven Ward, Kristel
Bennett, Karen O'Reilly, and Mark Waksmonski.
Minute Review: The Board of Health reviewed the minutes of the May 18, 2010
meeting. Dr. Barbara Beck made a motion to accept the minutes of May 18, 2010
meeting. Cynthia Brooks seconded the motion. All were in favor.
The Board of Health reviewed the minutes of the April 21, 2010 meeting. Cynthia
Brooks made a motion to accept the minutes of April 21, 2010 meeting. Dr. Barbara
Beck seconded the motion. All were in favor.
District 2 Presentation: Karen O'Reilly and Mark Waksmonski presented the April
and May 2010 Environmental and Community Health Report to the Board of Health.
Ms. O'Reilly discussed the ongoing animal control cases she is working on, the geese
management program, and the annual rabies clinic in April. Mr. Waksmonski discussed
ongoing environmental health cases he is working on, the MWRA Boil Water Advisory
response, and the Taste of the Towns event.
100 Dexter Avenue: Kristel Bennett provided an update to the Board of Health as to the
status of the condemnation of the property located at 100 Dexter Avenue. Owners Arthur
and Mary Papazian were present. After reviewing the supporting documentation
provided, hearing the findings of the June 15, 2010 Health Inspection report, and after
much discussion thereof, Dr. Barbara Beck made a motion to ratify the condemnation
order of March 2, 2010. In addition the Board of Health requires the owners of the
property to provide a written plan for accessing the dwelling to remove valuables, and to
either correct the violations listed in the Order to Correct letter dated March 2, 2010 or to

provide an alterative to vacate and secure or raze the dwelling by July 21, 2010 at the
next Board of Health meeting. Cynthia Brooks seconded the motion. All were in favor.
41 Quincy Avenue: Kristel Bennett updated the Board of Health as to the status of the
condemnation of the property located at 41 Quincy Avenue. Attorney Kathy McNair,
representative of owner Paul Zakszewski was present. After hearing the findings of the
June 16, 2010 Health Inspection report, after reviewing the supporting documentation
provided, and after much discussion thereof, Cynthia Brooks made a motion to ratify the
condemnation order of December 23, 2009. In addition the Board of Health required the
owner of the property to correct the violations listed in the Order to Correct letter dated
December 23, 2009 or to provide an alternative to raze the dwelling. The Board of
Health also requests that Attorney Kathy McNair provide a status report of progress made
regarding compliance with the Order to Correct letter of December 23, 2010 before the
next meeting of the Board of Health on July 21, 2010. The dwelling is to remain vacant
and secured. No dwelling or portion thereof which is ordered to be secured shall be
occupied without the written permission of the Board of Health based upon the Board's
written finding that the dwelling or portion thereof to be occupied is fit for human
habitation. Dr. Barbara Beck seconded the motion. All were in favor.
252 Common Street: Kristel Bennett updated the Board of Health as to the status of the
condemnation of the property located at 252 Common Street. Attorney Anthony Donato
Jr., representative of owner George Miller was present. After hearing the findings of June
16, 2010 Health Inspection report, after reviewing the supporting documentation
provided, and after much discussion thereof, Cynthia Brooks made a motion to ratify the
condemnation order of March 4, 2010. In addition the Board of Health required the
owners of the property to correct the violations listed in the Order to Correct letter dated
March 4, 2010 or provide an alternative to vacate and secure or raze the dwelling by July
21, 2010 at the next Board of Health meeting. The owner of 252 Common Street is
required to correct all the violations listed in the Order letter dated March 4, 2010 by July
21, 2010 at the next Board of Health meeting and inform as to how the owner will pay for
the cleaning of the dwelling. Dr. Barbara Beck seconded the motion. All were in favor.

66 Capitol Street: Kristel Bennett informed the Board of Health that the owners of 66
Capitol Street, John and Sandra Howard, were before the Board of Health for a status
hearing to update the Board as to the status of the condemnation order of the property
located at 66 Capitol Street. After hearing the testimony of John and Sandra Howard,
hearing the findings of the June 16, 2010 Health Inspection report, after reviewing the
supporting documentation provided, and after much discussion thereof, Dr. Barbara Beck
made a motion to ratify the condemnation order of March 5, 2010. In addition the Board
of Health requires the owners of the property to adhere to the signed Case Management
Agreement dated June 3, 2010 to remove valuables, and to comply with the Order to
Correct letter date March 5, 2010 and Fire and Building Safety Code. Non -adherence to
the Case Management Agreement will result in additional administrative action. Cynthia
Brooks seconded the motion. All were in favor.
La Romagnoli & Son's: Kristel Bennett informed the Board of Health that the
owner of La Romagnoli & Son's, Anna Romagnoli was before the Board for a request for
a hearing to withdraw a portion of the order to correct letter dated May 14, 2010 to
provide barrier protection for fresh pasta on display. After hearing the finding of Anna
Romagnoli, reviewing the Food Code 3-305.11 and 3-306.11, reviewing the supporting
documentation provided, and after much discussion thereof, Dr. Barbara Beck made a
motion that La Romagnoli & Son's must provide a suitable barrier as reference under
Food Code 3-306.11 to protect displayed pasta from contamination by the use of
packaging; counter, service line, or salad bar food guards; or other effective means. A
specification sheet, which visually depicts the said barrier, must be included with the
submitted plan review documents. The method of barrier protection must first be
reviewed and approved by the Health Department prior to its use. Until such time that an
approved barrier is installed all pasta must be removed from display. Cynthia Brooks
seconded the motion. All were in favor.
198 Summer Street: Kristel Bennett informed the Board of Health that the residents of
198 Summer Street and owners of 11 chickens and 20 rabbits were before the Board for a
request for a hearing for modification of compliance time with the order to correct letter
dated May 11, 2010 to remove chickens and rabbits for failure to submit a Keeping of

Animals application and receive a permit. The owners of the chickens and rabbits, John
and Laura McKenzie were present. Karen O'Reilly updated the Board as to the status of
the Keeping of Animals application. After hearing the findings of John and Lauran
McKenzie, reviewing the Keeping of Animals Regulations, reviewing the supporting
documentation provided, and after much discussion thereof, Cynthia Brooks made a
motion to extend the period of compliance time to the next Board of Health meeting on
July 21, 2010 subject to the submission of a complete application. Dr. Barbara Beck
seconded the motion. All were in favor.
OldlNew Business: Steven Ward discussed with the Board of Health the Emergency
Preparedness Grant expenditures, the NEHA Annual conference presentation in New
Mexico, and the CDC deliverables including but not limited to the Technical Assistance
Review (TAR) document.
