CALL TO ORDER: Mayor Merritt called the regular meeting of the City Council to order at 7:30 p.m. on Tuesday, November 17, 1981, in the Council Chamber of the City Hall. 2. The invocation was given by Dr. Edwin Linberg, Temple City Christian Church, 9723 Garibaldi Avenue. 3. The Pledge of Allegiance to the Flag was led by Mayor Merritt. 4. ROLL CALL: Present: Councilmen- Atkins, Dennis, Gillanders, Tyrell, Merritt Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Kimbrough, Planning Director Shaw, Parks and Recreation Director Kobett, and Julie Estrada, Temple City Times. 5. CONSENT CALENDAR: Councilman Atkins requested Item C on the Consent Calendar be removed for discussion, and moved to approve Items A, B, and D through I, seconded by Councilman Dennis and carried. A. APPROVAL OF MINUTES: Regular Meeting of November 3, 1981 Approved as written. B. RECOMMENDATION FROM PARKING COMMISSION - Meeting of November 11, 198.1 (1) AGREEMENT TO CROSS OVER PEDESTRIAN MALL NO. 4 - CHRISTY WILLIAMS, 96592 LAS TUNAS DRIVE Approved request subject to executing an agreement with the City and,meeting said requirements of the agreement. D. ORDINANCE NO. 81 -516: 2nd read. AMENDING TEMPLE CITY ZONING CODE TO ALLOW RETAIL SALES OF PORTABLE, SELF - CONTAINED SPAS AS A PERMITTED USE IN THE C -1 ZONE Waived further reading and adopted Ordinance No. 81 -516 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY PERMITTING THE SALE OF SPAS IN THE C -1 ZONE E. APPROVAL OF WATER SYSTEM: PARCEL MAP 12242 - 6131 GOLDEN WEST AVE. Found the work completed and released the Water System Agreement between the Subdivider and the City, and released the Faithful Performance Bond in the amount of $44,000. F. RENEWAL OF AGREEMENTS: STUDENT AND THE LAW - TEMPLE CITY UNIFIED SCHOOL DISTRICT /LUTHERAN SCHOOL /ST. LUKE'S /CLEMINSON Approved the agreements for the 1981 -82 school year and authorized Mayor and City Clerk to sign. Council Minutes, November 17, 1981 - Page 2 G. PROPOSAL FOR ELECTION SERVICES - GENERAL ELECTION 1982 Accepted proposal from Martin & Chapman Company for election services for the General Municipal Election to be held April 13, 1982. H. RESOLUTION NO. 81 -2026: REQUESTING AN ALLOCATION AND PAYMENT OF COUNTY AID -TO- CITIES FUNDS FOR THE MAINTENANCE OF SELECT SYSTEM STREETS Adopted Resolution No. 81 -2 -26 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING AN ALLOCATION AND PAYMENT OF COUNTY AID -TO- CITIES FUNDS FOR THE MAINTENANCE OF SELECT SYSTEM STREETS I. RESOLUTION NO. 81 -2027: WARRANTS AND DEMANDS Adopted Resolution No. 81 -2027 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $74,209.74, DEMAND NOS. 2881 THRU 2938 CONSENT CALENDAR ITEM #C: Councilman Tyrell felt that the poles should be removed and the job done before making the property owners pay for the work. Councilman Dennis inquired as to when the poles would be removed. In response to his request, City Manager Koski informed Council that the poles would be removed by December 1, 1981. Councilman Gillanders inquired as to whether the public hearing had to be held the first week in December. City Manager Koski informed him that it was not necessary. Councilman Gillanders preferred to have the public hearing postponed because he would not be able to attend the December 1, 1981, meeting. Councilman' Atkins moved to set the public hearing for Underground Utility District No. 4 regarding unpaid assessments, to January 19, 1982, seconded by Councilman Gillanders and carried. 6. UNFINISHED BUSINESS: A. PUBLIC HEARING: GENERAL PLAN AMENDMENT NO. 81 -1 AND ZONE CHANGE CASE NO. 81 -643 City Manager Koski presented background information, stating' that the Planning Commission, at their regular meeting of October 27, 1981, held a public hearing and approved and recommended to the City Council an amendment to the Temple City General Plan to include the recently annexed area bounded by Longden Avenue, Burton Avenue, Eaton Wash and an east -west line at the rear of lots fronting on the south side of Hermosa Drive. The General Plan Amendment reenforces the low density residential land uses existing in the area, amends the Circulation Element to include Burton Avenue as a collector street, and incorporates by reference all other General Plan Elements to include and apply to the subject area. The Planning Commission also approved and recommended to the City Council a zone change for the above described area from R -1 (County) to R -1 (City). Mayor Merritt declared the public wishing to speak to come forward. to speak, Councilman Atkins moved seconded by Councilman Gillanders hearing open and invited anyone There being no one come forward to close the public hearing, and carried. Councilman Atkins expressed his understanding that there was no real change in zoning and just basically a zone from County to City designation. City Manager Koski confirmed his summation. Council Minutes, November 17, 1981 - Page 3 City Attorney Martin directed Council's attention to the fact that all property in the annexation area is and would be R -1. City Attorney Martin presented Ordinance No. 81 -517 AN ORDINANCE OF THE CITY OF TEMPLE CITY REZONING ANNEXATION AREA 80 -1 TO R -1 for first reading by title only. Councilman Dennis moved to approve Negative Declaration and adopt Resolution No. 81 -2028 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING THE GENERAL PLAN (G.P. 81 -1), seconded by Councilman Atkins and carried. B. PUBLIC HEARING: STREET IMPROVEMENTS - CAMINO REAL, north and south sides, Oak Avenue easterly (curb, gutter and driveway approaches pursuant to Chapter 27, Streets and High- ways Code) City Manager Koski presented background information, stating that City Council at its regular meeting of November 3, 1981, received petitions for the installation of curb, gutter and driveway approaches from property owners on Camino Real east of Oak Avenue. This project will be combined with the already scheduled resur- facing of Camino Real from Oak Avenue to Temple City Boulevard; Halifax Road from Live Oak to Lower Azusa Road; and Muscatel Avenue from Las Tunas to Elm Avenue. The work is projected for April, 1982. City Manager Koski further explained that the project is in con- junction with the request for installation of sidewalks on the north and south side of Camino Real. City Manager Koski informed Council that some time in the past, the School District in a letter, re- quested sidewalks in this area. The request for sidewalks was also in keeping with the policy of the Traffic Commission. The estimated costs, cost sharing, and funding sources were referred to in the staff report. City Manager Koski explained that the City would pay 100% for sidewalks under SB 821. Councilman Atkins inquired as to whether or not curbs and gutters were included on both sides of Camino Real. City Manager Koski confirmed his inquiry. Councilman Tyrell expressed his opinion regarding the sidewalks and felt that sidewalks were not necessary on the north side of Camino Real. He felt that they would not be used and did not agree with the reasons given for the sidewalks. Councilman Gillanders stated that being that the funds for SB 821 came from gas tax and that all of the people contributed to this fund, he felt that these funds should only be used where necessary and that everyone should not have to pay for sidewalks for someone else. He also stated his objection to the City paying 100% for the sidewalks. Mayor Merritt stated that since the funding for the sidewalks came from gas tax that the property owners requesting the sidewalks were also indirectly paying a portion of the sidewalks. Assistant City Manager Kimbrough was asked to speak on the subject. He informed Council that the property owners were in favor of having sidewalks on both sides of the street and that the property owners understood that sidewalks would be recommended as part of the project. He further explained that both sides of the street would be used by students. In response to Council's questions, he reported that the sidewalks would be placed adjacent to the property line so that trees and shubbery on the parkways would not have to be removed. Assistant City Manager Kimbrough also indicated that sidewalks on the north side of Camino Real would be a continuation of the sidewalks already existing on the north side of Camino Real east of Brentmead. Council Minutes, November 17, 1981 - Page 4 Councilman Atkins moved to approve Negative Declaration; approve project pursuant to Council determination of policy re: shared costs; and appropriate additional funds and amend the adopted budget accordingly with the modification of deleting sidewalks on the north side of Camino Real seconded by Councilman Tyrell and carried on a roll call vote. ROLL CALL: AYES: Councilman- Atkins, Gillanders, Tyrell NOES: Councilman- Dennis, Merritt Councilman Dennis requested that the minutes reflect his no vote based on the exclusion of sidewalks on the north side of Camino Real. 7. NEW BUSINESS: 1 A. PUBLIC HEARING: ENTERTAINMENT AND DANCE PERMIT - TEMPLE INN SEAFOOD RESTAURANT, 8905 LAS TUNAS DRIVE City Manager Koski presented background information for the application from Denver Coleman for Business License, Entertainment Permit and Dance Permit for subject business due to new ownership of the established operators. The staff recommended that the entertainment hours be from 6 p.m. to 1 a.m., seven days a week. The entertainment will consist of either a piano or organ with a soft accompanist. Staff also recommended that the age of anyone participating in dancing should be limited to 18 years of age. Mayor Merritt declared the public hearing open and invited anyone wishing to speak to come forward. There being no one come forward to speak, Councilman Gillanders moved to close the public hearing, seconded by Councilman Dennis and carried. Councilman Gillanders moved to approve the categorical exemption of Environmental Impact and approve the Entertainment and Dance Permit subject to the conditions, seconded by Councilman Atkins and carried. 8. COMMUNICATIONS: None. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: None. RECESS TO CRA: City Council recessed at 7:58 p.m. to meet as the Community Redevelopment Agency, all members being present; approved the minutes of the regular meeting held November 3, 1981, and adopted resolution approving warrants and demands. The minutes of the Agency are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL. 10. ACTION ON REQUEST BY CRA: There was no action to be taken. 11. MATTERS FROM CITY OFFICIALS: A. FINAL TRACT MAP NO. 36739 - 9547 -53 GARIBALDI AVENUE - R -3 ZONE 1 Councilman Atkins moved to approve the reconfirmation of the final approval previously taken by Council on October 20, 1981, necessitated by the addition of signatures to the Tract Map pertaining to two Trust Deeds in favor of First City Bank as beneficiary, seconded by Councilman Gillanders and carried. 1 1 1 Council Minutes, November 17, 1981 - Page 5 B. Councilman Tyrell announced that two tennis teams, 5 members on each team, one B team and one D team entered the Michelob Open and won the Southern California Area Championship in each of their divisions; they then travelled to Dallas and competed against 44 other teams and won the Southwest Championship in both divisions; and finally, they travelled to Fresh Meadows where the B team came in first and won the National Championship and the D team came in 4th in their division. Councilman Tyrell mentioned that Temple City has provided activities and athletics for the working people of its community. C. Mayor Merritt announced that Edmund J. Frias was the new District Manager for Southern California Automobile Club. 12. ADJOURNMENT: On motion by Councilman Dennis, seconded by Councilman Gillanders, meeting adjourned at 8:08 p.m. Next regular meeting of the City Council will be held Tuesday, December 1, 1981, 7:30 p.m. in the Council Chamber of the City Hall.
