HomeMy Public PortalAboutORD14551 SUBSTITUTE PASSED AS AMENDED BILL NO. 2009-35 SPONSORED BY Councilman Struemph ORDINANCE NO. / 45-0 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A SPECIAL EXCEPTION USE PERMIT TO OPERATE A NEIGHBORHOOD CENTER/COMMUNITY ACTIVITY BUILDING LOCATED AT 1212 E. HIGH STREET, DESCRIBED AS PART OF LOT 9 OF OWEN'S SUBDIVISION OF OUTLOTS 55 AND 56, JEFFERSON CITY, COLE COUNTY, MISSOURI. WHEREAS, Charles Rental Company, LLC, owner of the real estate hereinafter described, having submitted an application to operate a Neighborhood Center/Community Activity Building, for the land described as follows: The northerly 108 feet of Lot Nine (9)of Owen's Subdivision of Outlots 55 and 56 of the City of Jefferson, Missouri, described as follows: Beginning at the northeasterly corner of said Lot No. 9; thence southerly along the easterly line thereof, 108 feet; thence westerly parallel with the northerly line of said Lot, 99 feet 2 inches to the westerly line thereof; thence northerly along said westerly line, 108 feet to the northwesterly corner of said Lot; thence easterly along the northerly line thereof, 99 feet 2 inches to the POINT OF BEGINNING. WHEREAS, it appears that the procedures set forth in the zoning code have in all matters been complied with, as said property owner submitted to the Planning and Zoning Commission and City Council an application for a Special Exception Use Permit for the above referenced property. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. The Special Exception Use Permit Application for a Neighborhood Center / Community Activity Building on file as Case No. P09018 in the Jefferson City Planning Division is hereby approved for the property described above, subject to the conditions in Section 2. SECTION 2. Conditions: Approval of the Special Exception Use Permit for a Neighborhood Center / Community Activity Building shall be subject to the following conditions: 1 SUBSTITUTE PASSED AS AMENDED 1. No outdoor activities shall be conducted on the property; 2. Hours of operation shall be limited to 8:00 A.M. to 10:30 P.M.; 3. The number of persons occupying the building shall be limited to 56, based on 14 on-site parking spaces.The number of on-site parking spaces shall not be reduced below 14. 4. Signage shall be limited to one sign over the main entrance (facing High Street) with a maximum area of 10 square feet and one other building mounted or monument sign with a maximum area of 18 square feet. Any monument sign shall have a maximum height of 5 feet. 5. No intoxicating liquor, as defined in Chapter 4. Alcoholic Beverages, shall be drunk consumed or cublicly exhibited on the premises. 6. No activities shall be conducted on the property that results in a final, non- appealable conviction of nuisance as defined by Chapter 21 of the Code of the City_of Jefferson, Missouri. 7. The property shall at all times be osted with "No Trespassing" signs in compliance with Section 18-72 of the Code of the City of Jefferson Missouri. SECTION 3.
