HomeMy Public PortalAbout1993-025Member Mayor Theis introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.93-25 RESOLUTION GRANTING A VARIANCE FOR GRANT GAGER AND CATHERINE GAGER WHEREAS, Grant Gager and Catherine Gager (Applicants) have requested a variance to reduce the required sideyard setback from 20 feet to 15.5 feet, to construct a garage and an addition to their living space at the house at 2225 Chestnut Road; and WHEREAS, section 825.45 of the City's code of ordinances and Minnesota Statutes, § 462.457 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicants' request and has recommended approval thereof; and WHEREAS, the city council has had an opportunity to review the matter and to hear from the Applicants regarding their request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicants' request for the above variance is granted, subject to the following conditions: 1. It is recognized that the garage and kitchen addition will not be located closer to the property line than the existing house; 2. It is recognized that the existing accessory shed is too close to the property line and if the Applicants add a detached accessory structure on the property, the existing shed must be removed; 3. It is recognized that the existing shed is nonconforming and that it cannot be rebuilt except in conformance with the provisions of the City's nonconforming use ordinance; RHH53067 ME230-8 i_ 4. The garage and kitchen addition must be constructed in strict accordance with the plans, specifications and drawings submitted by the Applicants and reviewed by the City; and 5. The Applicants must pay to the City an administrative fee in the amount necessary to reimburse the City for all expenses associated with reviewing this matter . NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina that the variance hereby granted is justified by the position and angle of the existing house, and the location of the well and septic system on the property.
