ORDINANCE NO. 145753
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE
VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO THE PRESENT CITY
LIMITS, INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED IN THE 1500-1700 BLOCK OF
LONDON WAY; DESCRIBED AS PART OF LOT 7 OF CAPITAL CITY INDUSTRIAL PARK AND
PART OF THE SOUTHWEST QUARTER OF SECTION 17, TOWNSHIP 44 NORTH, RANGE 12
WEST, IN THE COUNTY OF COLE, STATE OF MISSOURI; AND AMENDING SECTION 1-17
OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY
BOUNDARY BY ADDING ONE NEW SUB-SECTION PERTAINING TO THE SAME SUBJECT.
WHEREAS, pursuant to Section 71.012.2 RSMo,the City Council of the City of Jefferson desires
to annex the unincorporated area of land described in Section 1; and
WHEREAS, the property is owned by the City and used as London Way right-of-way;
WHEREAS, the property is adjacent to the City; and
WHEREAS, a public hearing concerning the annexation was advertised on June 5, 2009 in the
Jefferson City Post Tribune; and
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The City Council intends to and shall proceed to annex, as provided by law,the
unincorporated area of land described as follows:
Part of Lot 7 of"Capital City Industrial Park", in the City of Jefferson , Missouri, as per plat
of record in Plat Book 11, Page 170, Cole County Recorder's Office; part of the North Half of the
Southwest Quarter and part of the Southeast Quarter of the Southwest Quarter of Section 17,
Township 44 North, Range 12 West in the County of Cole, Missouri being more particularly
described as follows: Beginning at the southeasterly corner of the Southwest Quarter of the
Southwest Quarter of Section 17, thence N05°45'01"W, along the Quarter Quarter Section Line,
1385.34 feet to the northeasterly corner of the Southwest Quarter of the Southwest Quarter of said
Section 17; thence N05°30'00"W, along the Quarter Quarter Section Line, 314.81 feet; thence on
a curve to the left having a radius of 433.00 feet, an arc distance of 164.12 feet, (Chord:
N25°04'26"W, 163.14 feet); thence N35°55'56"W, 69.16 feet to the southerly right-of-way line of
Fairgrounds Road;thence along the southerly line of said right-of-way,on a curve to the left having
a radius of 517.46 feet, an arc distance of 203.44 feet, (Chord: N46°40'57"E, 202.14 feet),thence
S05°30'00"E, 651.94 feet; thence S05°45'01"E, 1386.71 feet to a point on the south line of the
Southeast Quarter of the Southwest Quarter of said Section 17; thence S85°30'00"W, along the
Section Line, 70.02 feet to the POINT OF BEGINNING. Containing, in all, approximately 3.45
acres.
Section 2. The City Council finds and declares that the land described in Section 1 is
contiguous to the City boundary; that the annexation is reasonable and necessary to the proper
development of the City; and further, did determine the City has an ability to furnish normal
municipal services to this area.
Section 3. A public hearing was held on June 15, 2009 as provided by law, concerning
the annexation of the unincorporated area described in Section 1.
Section 4. The land described in Section 1 shall be zoned M-1 until such time as the zoning
may be changed in the manner provided for by State Statute and City Code.
Section 5. Section 1-17 of the City Code of the City of Jefferson, Missouri is hereby
amended by adding one new subsection which shall read as follows:
( ) The Ci 's boundaries shall also include the following parcel: Part of Lot 7 of
"Capital City Industrial Park", in the City of Jefferson , Missouri, as per plat of record in Plat Book
11, Page 170, Cole County Recorder's Office; part of the North Half of the Southwest Quarter and
part of the Southeast Quarter of the Southwest Quarter of Section 17, Township 44 North, Range
12 West in the County of Cole, Missouri being more particularly described as follows: Beginning

Section 6. The annexed area shall be in Ward 4 of the City.
Section 7. The effective date of this Ordinance and the annexation of the area described
in Section 1 will be immediately upon passage, provided that no written objections to the proposed
annexation are filed with the City Council. If sufficient objections are filed, this ordinance shall not
become effective until such time as the annexation issue has been resolved pursuant to the
provisions of Chapter 71 RSMo.
