A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF OPA-LOCKA, FLORIDA, REQUESTING APPROVAL OF A
CHANGE ORDER FOR JVA ENGINEERING CONTRACTOR,
INC., TO PERFORM ADDITIONAL WORK FOR RUTLAND
STREET ROADWAY AND DRAINAGE IMPROVEMENTS
BETWEEN 23RD AVENUE AND 22ND AVENUE, INCLUDING
DRIVEWAY APRONS FROM NW 24TH AVENUE TO NW
22ND AVENUE, IN AN AMOUNT NOT TO EXCEED
$149,490.00, PAYABLE FROM CAPITAL PROJECTS FUND,
PAYABLE FROM ACCOUNT NUMBER 47-541807, ITEM IS
NOT BUDGETED; PROVIDING FOR INCORPORATION OF
RECITALS; PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the City issued a Request for Proposals for the improvement of
Rutland Street Drainage System; and
WHEREAS, JVA Engineering was awarded the contract for the Rutland Street
roadway and drainage improvement; and
WHEREAS, a Change Order is requested to extend the scope of services to
include the remaining portion of Rutland Street from NW 23rd Avenue to NW 22nd
Avenue (roadway and drainage improvement), and also driveway aprons between NW
24th Avenue and NW 22nd Avenue; and
WHEREAS, the City Commission of the City of Opa-locka desires to approve the
Change Order for additional work for Rutland Street Roadway Drainage improvements
between 23rd Avenue and 22nd Avenue, including driveway aprons from NW 24th
Avenue to NW 22nd Avenue.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA:

Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City Commission of the City of Opa-locka, hereby approves a
Change Order for JVA Engineering Contractor, Inc., to perform additional work on
Rutland Street Roadway and Drainage improvements between 23rd Avenue and 22nd
Avenue, including driveway aprons from NW 24th Avenue to NW 22nd Avenue, in an
amount not to exceed $149,490, payable from Account Number 47-541807, this item is
not budgeted.
Section 3. This resolution shall take effect immediately upon adoption.

Staff Summary:
The City of Opa-locka issued a Request for Proposal (RFP) to solicit competitive proposals from qualified firm for
the improvement of Rutland Street Drainage System. JVA Engineering Contractor was awarded the contract for
the Rutland Street Roadway and Drainage Improvements. The original scope included only the portion of Rutland
Street between NW 24 Avenue and NW 23rd Avenue without driveway aprons due limited grant fund. The change
order is to extend the scope of services to include the remaining portion of the Rutland Street from NW 23
Avenue to NW 22 Avenue for Roadway and Drainage Improvements and also all the driveways between NW 24th
Avenue and NW 22nd Avenue.
Staff recommends approval in order to improve Rutland Street drainage and roadway condition.

Financial Impact: This was not budgeted. It will impact City's FY 2012-2013 budget by$149,490.02.

Recommendation(s): Staff recommends approval in order to improve Rutland Street drainage and
roadway condition.
Analysis: Rutland Street between NW 23rd Avenue and NW 22nd Avenue experiences frequent flooding
and the pavement surface has deteriorated significantly. Under this change order the roadway surface will
be milled and resurfaced as necessary in addition the drainage and driveway apron improvements. The
proposed change order will help improving the street level of service.

• JVA can not complete their task will be paid by owner
The work and performed by the Co may result in a lien being placed on the premises described above,in case the owner
or contractor default its in any payment under this contract.
Owner hereby agrees to accept full responsibility for all fences,sidewalks,all underground pipes,wires,septic tanks,
drain lines,well,ect unless stated above.
Owner is liable in full amount of contract in the event owner cancel after work has started.
The Co shall not be responsible for damage or delays do to strikes,fires,accidents,or the others cause beyond its
control,not for inherent defects in the premises on which work to be done.
In the event of any default of this contract by owner-owner agrees to pay all cost and reasonable attorneys
by JVA Engineering Contractor,INC.as a result of said default.
All materials are guaranteed to be as specified. All work to be completed in a workman like manner according to standard
practices. Any alteration or deviation from above specifications involving extra cost will be executed only upon written
orders and will become an extra charge over and above the estimate.
This proposal subject to acceptance within_30_days and is void thereafter at the option of the under signed.
Work shall begin 10 days of this contract being signed by all parties here and return to the co.
WE HEREBY PROPOSE TO FURNISH LABOR AND MATERIALS COMPLETE IN
SPECIFICATIONS, FOR One Hundred Forty Nine Thousand Four Hundred Ninety

ENGINEERING CONTRACTOR, INC FOR
IMPROVEMENTS FOR RUTLAND STREET DRAINAGE
SYSTEM AND ROADWAY,IN AN AMOUNT NOT TO EXCEED
ONE HUNDRED TWENTY SEVEN THOUSAND EIGHT
HUNDRED FIFTY DOLLARS($127,850),PAYABLE FROM THE
PTP FUND AND CAPITAL PROJECTS FUND, ACCOUNT
NUMBERS 47-541807 AND 44-541807; PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR AN

WHEREAS, pursuant to Resolution No. 12-8415, the City of Opa-locka issued Request
for Proposals(RFPs) for improvements of Rutland Street Drainage System; and
WHEREAS, three bidders responded to RFP 12-1607100 for improvements of Rutland
Street Drainage System, 1) JVA Engineering, 2) FLA Engineering, and 3) Williams Paving
Company, Inc.; and
WHEREAS, the RFP Evaluation Committee ranked the bidders based on price proposal,
references, local work force participation and other criteria, and recommends awarding the
contract to JVA Engineering Contractor, Inc.; and
WHEREAS, the City of Commission of the City of Opa-locka desires the City Manager
to execute contract with JVA Engineering Contractor, Inc. for improvements to Rutland Street
Drainage System.
NOW,THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF OPA-LOCKA,FLORIDA:

Section 2. The City Commission of the City of Opa-locka, authorizes the City
manager to execute contract with JVA Engineering Contractor, Inc for improvements of Rutland
Street Drainage System and Roadway, in an amount not to exceed One Hundred Twenty Seven
Thousand Eight Hundred Fifty Dollars($127,850),payable from the PTP Fund and Capital
Projects Fund, Account Numbers 47-541807 and 44-541807.
Section 3. This resolution shall take effect immediately upon adoption.
