HomeMy Public PortalAbout1993-032s Member Philip Z i e t 1 ow introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 93-32 RESOLUTION GRANTING PRELIMINARY APPROVAL FOR A REPLAT OF LOTS 1-4, BLOCK 31, INDEPENDENCE BEACH WHEREAS, Vola Latinus is the fee owner and Mark Klingelhoets and Gwen Klingelhoets are the purchasers (collectively, "Applicants") of Lots 1-4, Block 31, Independence Beach, Hennepin County, Minnesota (the "Subject Property); and WHEREAS, the Applicants have proposed to replat the Subject Property into two lots; and WHEREAS, the proposed replat was reviewed by the planning commission on May 11, 1993 and by the city council on June 1, 1993. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that preliminary approval is hereby granted for the replat of the Subject Property, subject to the following conditions: 1. The final plat must dedicate the right-of-way for Co. Rd. 19 required by the city engineer; 2. All grading must be completed on both proposed lots 1 and 2 when construction is begun on a house on either lot. This work shall include construction of a drainage swale which must be sodded and a silt fence; 3. The final plat must show all drainage and utility easements required by the city engineer; 4. The screen porch located on proposed Lot 2 must be structurally improved to the satisfaction of the building inspection by no later than October 1, 1993; 5. The parties recognize and acknowledge that the screen porch on proposed Lot 2 is a non -conforming structure which is subject to the city's non -conforming use ordinance; 6. The screen porch located on proposed Lot 2 must be removed if construction of a primary structure on that lot has not commenced within two years of the date of the resolution granting final plat approval; RHB54218 ME230-182 7. The Applicants must pay a park dedication fee for Lot 2 in the amount determined by city staff; 8. The Applicants must submit a current Abstract of Title or Registered Property Abstract covering all of the Subject Property for review by the city attorney; 9. The Applicants must submit the final plat to the zoning administrator within 180 days of the date of this resolution, which final plat shall in all material respects conform to the preliminary plat, except that it shall incorporate all changes and modifications required by this resolution; and 10. The Applicants must pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city for reviewing the plat. Dated: June 15 , 1993. An C.
