RESOLUTION NO. 78-54
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD TO PARTICIPATE IN CONTRACT WITH THE
LYNWOOD SERVICES INC. FOR CETA PERSONNEL.
THIS AGREEMENT dated April 1,. 197.8 between the City of Lynwood
and the' Lynwood Services Inc. establishes the conditions of~the contract,
'and shall apply to all job sites in which Federally funded CETA personnel .
will be placed, their hours, wages, number of job sides to be provided by -
the City and the conditions of employment-in the City job sites.
- 1NOW, THEREFORE, in consideration of the mutual terms and
conditions hereinafter set forth, it is agreed as follows.:
ARTICLE I ,POWERS OF THE CITY
Section I Number. of Job Sites
The City of Lynwood agrees to provide nineteen (19) job sites
for the duration of this contract. 'The job sites will be allocated in this
manner:
Fire 4 sites City Hall 3 sites . .
Garage 3, sites Park & Recreation 6 sites
Street 3 sites '. •
Section II Method of Refilling Job Sites, Transfers, Removals
from a Job Site..
(a) Refilling a Vacant .Job Site
,The City department head requesting a refilling of a job site will forward
.said request to the Personnel Officer who shall in turn contact the Lynwood
Services delegate as to the City's needs. The Lynwood Services shall endeavor
to send at least three (3) candidates for the City department head's review.
' (b) Transfer ~ ,_ -.~ ~ -
The City .shall have .the option to transfer any individual under CETA from
one job site to another as the City sees fit. Notification will be given
to the delegate of the Lynwood Services Inc. prior to the- action.

(c) Removal
Any or all job sites may be cancelled by the City of. Lynwood, provided the
City serves notification of termination.- The City of Lynwood also reserves
the right to reject ariy individual from a job site, due to poor performance
in the eyes of the City of Lynwood, lack of attendance, or any other reason that
in the Gity's eyes the individual(s) do not meet the standards of the City.
Section III Background Check
A 11 job site applicants must have a background arid driver's license check,
and pass. satisfactorily prior to placemerit in a job site. A physical exam
may be required.
o ,Section IV Maintenarice of Effort
The City of Lynwood and Lynwood Services Inc. will strictly adhere to the
intent of Section 96.23(11) and 96. 24~of the Federal Register current regulations
for Tit 1e I, II, and VI. In this vein, .to CETA job. sites will be.utilize,d
to replace a current classified employee, position or classification.
Section V City Rules and. Regulations
_. AlT CETA..job sites will operate under those operating procedures-for that-
department and the City.
Section VI Hours
All CETA personnel will .maintain those hours of the department to which they
are assigned. No CETA personnel will work overtime unless the department
requesting, the overtime has signed approval of the Personnel Office of the
City and ~of: Lynwood' Services Inc. agent.
ARTICLE II EQUIPMENT, BUILDING
Section I Hand Equipment/Safety Equipment
All CETA workers shall provide their own tools of their trade. In those
job sites where large or special equipment is. rieeded the City may provide
said equipment. All CETA job sites will req.u-ire proper safety attire,
work habits, and adherence to the safety rules and regulations.

ARTICLE~III FINANCE, ACCOUNTS AND REPORTS
Section I Finance
The City shall not at any time contribute monies for the operation, maintenance
or assist the Lynwood Services Corporation. The Lynwood Se,rwices agency
is a separate corporation. However the Lynwood Services Corporation will
submit ,quarterly reports to the City's administrative office as to the
. financial status, ethnic statistics, .projects slated for that period. .
• (a) .All support services for directing, administering, and
approving the payroll, monthly reports, accounts payable and receivable
shall be the sole responsibility of Lynwood Services Inc. .
Section II • Inspection of Records
The books and records of the Lynwood Services Inc, shall be open to
inspection at all reasonable times by the. parties liereto.
Section III Disposition of Assets
Upon termination of the. agreement, all property of the Lynwood Services Inc.
shall be distributed among the, parties hereto.
.ARTICLE IV DURATION
- Section I Duration of Contract . .
The contract between the City of. Lynwood and Lynwood Services Inc. shall
. be from. 4/1 / 78 to 9./29 / 78. If anal when the Lynwood Services Inc. receives .
funding for another term the parties hereto may enter into another contract,
however the contract can not .exceed 12 months in duration.
