CALL TO ORDER: Mayor Merritt called the regular meeting of the City Council to order at 7:34 p.m. on Tuesday, December 15, 1981, in the Council Chamber of the City Hall. 2. The invocation was given by Mike Gleason, Assistant to the Pastor, 1st Baptist Church of Temple City, 6019 N. Baldwin Avenue. 3. The Pledge of Allegiance to the Flag was led by Mayor Merritt. 4. ROLL CALL: Present: Councilmen- Atkins, Dennis, Tyrell, Merritt Absent: Councilmen - Gillanders Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Kimbrough, Planning Director Shaw, Chief McCann, Fire Department, and Julie Estrada, Temple City Times Councilman Tyrell moved to excuse Councilman Gillanders for cause, seconded by Councilman Atkins and carried. 5. CONSENT CALENDAR: Councilman Atkins moved to approve Items A through H on the Consent Calendar as recommended, seconded by Councilman Dennis and carried. A. APPROVAL OF MINUTES: Regular Meeting of December 1, 1981 Approved as written. B. PLANNING COMMISSION ACTION - Meeting of December 8, 1981 Received and filed memo relating to action taken by the Planning Commission at their regular meeting held December 8, 1981. C. ACCEPTANCE OF WORK: SLURRY SEAL PROJECT - MAINTENANCE AREA # #1 Accepted the work performed pursuant to specifications for Maintenance Area #1 and a portion of Maintenance Area #6, not including the work in the area recently chip sealed, and authorized a progress payment to the contractor in the amount of $44,839.18. D. APPROVAL OF SURVEY MONUMENTS: TRACT 37579 Halifax /Freer /Arden /Hallowell Approved the monument and tie points completed by the private contractor and released dash deposit in the amount of $2,500.00. E. REQUEST TO USE FACILITIES FEBRUARY 26, 27, and 28, 1982 38TH ANNUAL CAMELLIA FESTIVAL COMMITTEE Approved request from the Camellia Festival °Committee for use of , various facilities as set forth in their letter dated December 4,' 1981, subject to all necessary permits and legal requirements, including Certificate of Insurance in the amount of $5 million. F. CLAIM FOR DAMAGES: Nell G. Connolly Received claim for damages alleged to have occurred August 28, 1981 in the parking lot at 9635 Las Tunas Drive and denied and referred to JP IA . RESOLUTION NO. 81 -2034: EMPLOYMENT OF PERSONNEL Adopted Resolution No. 81 -2034 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL. H. RESOLUTION NO. 81 -2035: WARRANTS AND DEMANDS Adopted Resolution No. 81 -2035 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $141,100.22, DEMAND NOS. 2991 THRU 3210. 6. UNFINISHED BUSINESS: None. 7. NEW BUSINESS: None. 8. COMMUNICATIONS: A. WEST SAN GABRIEL VALLEY HEALTH ADVISORY COUNCIL City Manager Koski presented communication from West San Gabriel Valley Health Advisory Council requesting City Council support reallocation of necessary resources to the Alhambra Health Center. Councilman Tyrell stated he does not feel Council can evaluate whether this would be an appropriate action, since the County budget in not within Council's purview and moved to receive and file, seconded by Councilman Atkins and carried. B. City Manager Koski stated Assemblyman Mountjoy's office called regarding reapportionment litigation and requested supported as friends of the court. Councilman Tyrell stated that, assuming it would be an appropriate action, he doubted the City Attorney would be able to do anything within the time allotment. City Attorney confirmed and Council received and filed. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mr. George Maier, 10808 E. Olive Street, stated he has erected a fence on the corner of his lot which he has been told does not meet the City code. He feels he has been unfairly treated because of so many other violations of the same ordinance. The fence keeps the headlights of vehicles shining in his house, reduces noise and gives him privacy. In answer to, question from Council, Mr. Maier stated he erected the fence to replace the shrubbery he was required to cut back. 1 1 In answer to questions from Council, Planning Director Shaw stated he drove Olive Street from Baldwin to Arden and did not see any overt violations of the code; that is, solid wall or fence in excess of the height allowed. There were some incidents of fences which have been overgrown with ivy since their erection and might now be in violation of the code. Councilman Atkins stated he is not sure what Mr. Maier is asking for Can a variance be granted for something like this? Councilman Ty(rel stated the fence was installed after having to reduce the height of the shrubbery in direct violation of the code and a variance can't be given for that. In his opinion, the problem lies in the fact ;there is no permit system for erecting fences. Councilman Tyrell moved to refer the matter to the Planning Commission rnr their review, seconded by Councilman Dennis and carried. }' ECESS TO CRA: Al. this time, Council recessed .to net as the Community Redevelopment Agenc:: approved the minutes of December 1, 1981 and approved annual report from Council Minutes, December 15, 1981 - Page 3 July 1, 1980 to June 30, 1981 and transmittal to the City Council. The minutes are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: I 10. ACTION ON REQUEST BY CRA: A. ANNUAL REPORT - JULY 1, 1980 TO JUNE 30, 1981 Councilman Atkins moved to accept the Community Redevelopment Agency Annual Report and instruct staff to transmit to Department of Housing and Community Development, seconded by Councilman Dennis and carried. 1 IATTEST: 11. MATTERS FROM CITY OFFICIALS: A. CALIFORNIA MUNICIPAL TREASURERS ASSOCIATION ANNUAL WORKSHOP - POMONA, FEBRUARY 19 -21, 1982 Councilman Atkins moved to approve the attendance of the City Treasurer to subject conference and authorize necessary expenses, seconded by Councilman Dennis and carried. B. Mayor Merritt stated he had received a letter from East San Gabriel Valley Services for the Disabled requesting financial assistance in the amount of $1,000 to maintain their level of service. It was Council's opinion the Mayor write a letter and explain the City cannot make a donation of public funds. C. Councilman Tyrell directed Council's attention to the memo from George Voigt to the subcommittee of City Managers regarding fire district reorganization, stating he feels it is appropriate to get the Board of Supervisors out of the district and would like more information on this matter. D. Councilman Atkins expressed concern over young girls being dropped off in the community after dark to solicit from door to door, stating it is a major safety problem. He also requested staff obtain a copy of a new ordinance adopted by the City of Pasadena which prohibits after dark solicitation. 12. ADJOURNMENT: On motion by Councilman Atkins, seconded by Councilman Tyrell, meeting adjourned at 8:17 p.m. Next regular meeting of the City Council will be held Tuesday, January 5, 1982, 7:30 p.m. in the Council Chamber of the City Hall.
