JEFFERSON, BY REZONING 0.15 ACRES FROM RA-2 HIGH DENSITY RESIDENTIALTO
C-1 NEIGHBORHOOD COMMERCIAL, FOR LAND ADDRESSED AS 801 WEST HIGH
STREET, DESCRIBED AS PART OF INLOT NO. 407, JEFFERSON CITY, COLE COUNTY,
MISSOURI.
WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning
have in all matters been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The following described real estate is rezoned from RA-2 High Density
Residential to C-1 Neighborhood Commercial:
The northerly 128 feet, 9 inches of the easterly 52 feet, 2 inches of Inlot No.

17, 2009 at 6:00 p.m. in the Council Chamber of the John G. Christy Municipal Building, 320 East

Residential to C-1 Neighborhood Commercial:

Case No. P09024—801 W. High Street; Rezoning from RA-2 to C-2. Application filed
by Frederick VanLoo, authorized representative, A-OK Sales and Rentals, property
owner, to rezone 0.15 acres from RA-2 High Density Residential to C-2 General
Commercial. The property is located on the southwest corner of West High Street and
Clay Street. The property is described as part of Inlot No. 407, Jefferson City, Cole
County, Missouri.
Mr. Barron described the proposal and explained that the Applicant is proposing a zoning
of C-2 General Commercial to the make property available for commercial use. He stated
that when a residential property is converted to a commercial use that property will have to
meet normal parking requirements. Mr. Barron explained that the parking requirements could
be satisfied either by construction of a parking lot or leasing surrounding spaces.
Mr. Frederick VanLoo, 5601 Rolir, i Road, Authorized Representative, spoke regarding
this request and explained that the subject. property is currently vacant and he is proposing to
rezone it to commercial to make it more desirable for potential buyers. He stated that the
property would be ideal for office use.
No one spoke in opposition to this request. Correspondence in favor of this request was
received from Joseph Bryan, 304 Bolivar Street.
Mr. Barron gave the Planning Division staff report and explained that the rezoning
request would be an expansion of an existing C-2 General Commercial zoning district. He
stated that there is some concern that a C-2 zoning would allow uses that might not be
compatible with some of the surrounding residential uses in this area. Mr. Barron explained
that staff would be in support of a revised rezoning request to C-1 Neighborhood Commercial
which allows for potential uses such as offices, general retail and personal services. He
stated that the subject property is in the vicinity of several residential uses and C-1 zoning
would be preferable.

Ms. McMillan clarified that the RA-2 zoning district prior to 2002 allowed for office uses
including medical office uses as a conditional use. She suggested that perhaps an approach
would be to apply the zoning that has the least intensity but still accomplishes the purpose.
After additional discussion, Mr. VanLoo stated that he has no objections to staff's
recommendation to rezone the subject property to C-1, Neighborhood Commercial instead of
C-2 General Commercial.
Mr. Lake moved and Mr. Bickel seconded to recommend approval of rezoning 801 W.
High Street from RA-2 High Density Residential to C-1 Neighborhood Commercial to the City
Council. The motion passed 8-0 with the following votes:

authorized representative, A-OK Sales and Rentals, property owner, to rezone 0.15 acres from RA-2 High Density
Residential to C-2 General Commercial. The property is located on the southwest corner of West High Street and CIay
Street. The property is described as part of Inlot No. 407, Jefferson City, Cole County, Missouri.
Nature of Request
This rezoning request is for a small tract of land that consists of 0.15 acres. The property is currently zoned RA-2
multi-family residential and a residential style structure exists on the property. Use of the property as a bed and
breakfast was approved through a conditional use permit on May 11, 1993, by the Board of Adjustment. The
applicant is proposing a zoning of C-2 General Commercial. The purpose of the proposed rezoning is to make the
property available for commercial use.

Rezoning Request:
This rezoning request would be an expansion of an existing C-2 General Commercial zoning district and is in
conformance with the development plan map of the comprehensive plan. The property is located adjacent to
Highway 54, which is classified as a freeway/expressway and has an average daily traffic volume of over 49,000
vehicles. The high traffic count of the adjacent highway and the existence of several other businesses in the area
reduce the potential for comfortable use of the property in a residential manner. While a C-2 zoning may be
appropriate for the property, a zoning of C-1 Neighborhood Commercial would allow many of the ideal uses for the
property (such as offices, general retail, and personal services) while protecting the existing residential uses in the
area from the more intensive uses allowed within the C-2 district. Staff are in support of the request to rezone the
property from RA-2 to C-2. Staff would also be in support of a revised request to rezone the property to C-1
Neighborhood Commercial.
Staff recommends the following:

I currently own 4 properties in the immediate area(70 West High, 719 West High,304
BoliY�r and 704 Cliff Street). I would like to see a blanket change to make all these
prop�lrties in the area C-2. The current owners could either leave their houses as a
residential or make them C-2 if needed. If you surveyed the neighborhood you would
see that it is spot-zoned now which is confusing.
