`~ A RESOLUTION OF THE CITY COUNCIL OF THE ..
` CITY OF LYNWOOD DENYING A,CONDITI'ONAL`
.. USE PER1`4IT TO OPERATE A FACILITY FOR
RETURNEES FROM STATE AND/OR COUNTY,IN-
STITUTIONS.AT 12519 ATLANTIC AVENUE.
WHEREAS, the City of Lynwood has received an
application for a Conditional Use Permit from.Mr. Sam Menlo ,
`to .operate a facihity-for returnees from state. and/or county
institutions on Lots 1.2 and 15, Tract 7Q99, which property
is known as 12519 Atlantic Avenue; .and
.WHEREAS, the Planning Commission of the City. of
° .Lnywood,.after gving,notice.thereof~as required. by law, has
.;..,held and ,conducted a public hearing concerning said applica-
tion and,`based.upon~the evidence presented thereat, has
adopted its Resolution No. 6,51 denying said .Conditional Use
. Permit; and
WHEREAS;~the applicant has appealed the .decision of
the~Planning•Commission to the City. Council of the City of
. Lynwood; -and
WHEREAS,,said City Council,-after providing notice
thereof as required by law, has held and conducted a public
hearing~to consider said appeal and has heard and considered
all pertinent evidence presented thereat,
NOW, THEREFORE, the City Council of the City of
~. Lynwood hereby does find, determine, resolve, and order as

Section 1. The proposed site for the use requested
in ,the aforesaid Conditional Use Permit application is not
adequate in size and shape to accommodate said use in that
it will not allow for .the provision of adequate recreational
areas,-particularly outside recreational areas, which are
necessary in order to afford residents o.f such facility an ,
`opportunity for on-site recreation-and .reduce the likelihood
bf their interfering with the-privacy of .nearby residences.,
businesses, and other facilities. .
Section 2. The.. use requested will have an adverse
effect on abutting and nearby properties.
`. Section 3. The u'se requested is not compatible with
the surrounding neighborhood in that the site is directly across
froma grammar school playground which is generally used. by the
. children attending ,said school without adult supervision .during
the afternoon hours and the close proximity .thereto of returnees
from state .and/or county institutions could- endanger the health,
safety and general welfare of such children. and of others. in
the neighborhood.
Section 4. On the basis of the evidence presented
to it, .the. City Council cannot make the affirmative findings
required by the Lynwood Zoning Ordinance in order to grant
the subject Conditional Use Permit.
r- Section 5. The decision of the Planning Commission
of the City of Lynwood hereby is upheld, and said application
for a Conditional Use Permit hereby is denied. The City.Clerk
hereby is authorized and directed to give notice thereof to
the applicant by transmitting a copy of this resolution to him.
APPROVED AND ADOPTED this 21st day, of November, 1978.
