HomeMy Public PortalAbout1993-043Member Mayor Anne Theis adoption: introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO. 93-43 RESOLUTION GRANTING AN AMENDED CONDITIONAL USE PERMIT TO ROBERT ROMFO AND ANITA ROMFO AND THE LONG LAKE HOUNDS WHEREAS, Robert Romfo and Anita Romfo and the Long Lake Hounds (collectively, Applicants) received a conditional use permit in 1989 for a fox hound kennel associated with an actively recognized hunt at property located at 2832 Hamel Road; and WHEREAS, such permit was granted by the Medina city council by Resolution No. 89-18; and WHEREAS, the Applicants have requested an amendment to the conditional use permit; and WHEREAS, their request was reviewed by the planning commission at its June 8, 1993 meeting. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina that an amended conditional use permit be issued to the Applicants for the stated purpose, subject to the following conditions: 1. There shall be no more than 54 fox hounds of any age on the property at any time; 2. There shall be a maximum of nine runs which shall not exceed 35,000 square feet; 3. Hours of operation shall be 24 hours per day, seven days per week; 4. Waste material from the hounds must be contained in a holding tank of at least 1,000 gallon capacity which must be pumped regularly in conformance with the regulations of the Minnesota pollution control agency and the city. The holding tank must be installed on or before November 1, 1993; R8 355807 ME230-186 5 . The Applicants must take immediate and appropriate action to abate any nuisance caused by barking hounds on the property. A nuisance is defined to include, but not be limited to, 10 minutes of continuous barking; 6. No hounds may be sold or used for experimental purposes; 7. The Applicants must maintain all hounds in accordance with the standards of the Minnesota Purebred Dog Breeders Association; 8. The Applicants agree to take whatever steps may be necessary to reduce outside visual stimuli for the hounds in the kennels if excessive barking becomes a problem; 9. The city reserves the right to review the property to insure continued compliance with the terms and conditions of this permit. If it is found that the conditions have been violated, this conditional use permit may be revoked; 10. The city reserves the right to modify or amend the terms and conditions of this conditional use permit as development occurs on adjacent properties if necessary to prevent the occurrence of a nuisance; 11. Drainage of the runs into the wetlands must be addressed and corrected to the satisfaction of the city staff on or before November 1, 1993; 12. The Applicants must be in compliance with all current state and federal statutes pertaining to animal welfare; 13. All animals covered by this conditional use permit must be owned by the Long Lake Hounds and no commercial use may be made of the facility; 14. The Applicants must pay to the city a fee in the amount determined by the staff to represent the actual cost to the city of reviewing this amended conditional use permit application; 15. The Applicants must reimburse the city for all costs, including legal expenses, involved in enforcing any provision of this amended conditional use permit or any ordinance related thereto; and 16. The Applicants must post cash or a letter of credit in the amount of $3,500 with the city to ensure completion of items 4 and 11 of this resolution. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota that Resolution No. 89-18 is revoked upon adoption of this resolution. Dated: July 20 , 1993. Anne E.
