ORDINANCE NO. 859
AN ORDINANCE OF THE CITY OF MCCALL, VALLEY COUNTY, IDAHO AMENDING
MCCALL CITY CODE SECTION 3.8.09 PROVISIONS FOR TRASH STORAGE,
COLLECTION AND DISPOSAL THAT REQUIRES TRASH ENCLOSURES TO GO
THROUGH THE DESIGN REVIEW PROCESS WITH APPROVAL FROM THE PLANNING
AND ZONING COMMISSION AND REPLACE WITH AN ADMINISTRATIVE APPROVAL
PROCESS.
WHEREAS, an application for approval of a code amendment, pursuant to MCC 1-1-3, was
submitted by the City of McCall on May 20, 2008; and
WHEREAS, the code amendment would change the approval process for trash-enclosing
structures required by MCC 3.8.09; and
WHEREAS, the purpose of the this code amendment is to simplify the approval process for
proposed trash enclosures; and
WHEREAS, currently, a trash enclosure must receive approval through the Design Review
process which is approved by the Planning and Zoning Commission; and
WHEREAS, the proposed Code Amendment would allow the Administrator to approve designs
for trash enclosing structures; and
WHEREAS, the McCall Area Planning and Zoning Commission held a properly noticed and
regularly scheduled public hearing on July 1, 2008 to consider the proposed code amendment;
and
WHEREAS, the McCall Area Planning and Zoning Commission recommended the proposed
Code Amendment for approval by the McCall City Council at the July 1, 2008 meeting; and
WHEREAS, the proposed code amendment was approved by the McCall City Council at a
regularly scheduled and properly noticed public hearing on August 14, 2008.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY
OF MCCALL, IDAHO, AS FOLLOWS:
Section 1: McCall City Code Section 3.8.09 is amended to read as follows:
3.8.09: PROVISION FOR TRASH STORAGE, COLLECTION AND DISPOSAL:
It is recommended that all trash be collected by a community trash collection facility. An
enclosed, or sight obscuring, structure is required for all trash collection containers,
unless these containers are kept in a building. Sight obscuring structures, if in a
commercial or industrial zone, are subject to the provisions of chapter 16, "Design
Review", of this title. If the collection containers are outside of a building, then they must
be designed to be animalpreef, especially against bears, raccoons, and other animals.

3.8.09: PROVISION FOR TRASH STORAGE, COLLECTION AND DISPOSAL:

commercial or industrial zone, are subject to administrative approval of the enclosure
design. If the collection containers are outside of a building, then they must be designed
to be animal -proof, especially against bears, raccoons, and other animals.
Section 2: This Ordinance shall take effect immediately upon its passage and approval.
