HomeMy Public PortalAbout1993-050Member John Ferris introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 93-50 RESOLUTION GRANTING AN AMENDED CONDITIONAL USE PERMIT TO U.S. WEST NEWVECTOR GROUP WHEREAS, U.S. West NewVector Group (Applicant) has applied for an amended conditional use permit to install additional antennas to the existing communications facility consisting of a tower and antennas and an accessory building (Facility) at the site of the city water tower, which property is legally described as Outlot A, Medina Industrial Addition; and WHEREAS, the Applicant was originally granted a conditional use permit for the Facility in 1990; and WHEREAS, the request to amend the conditional use permit was reviewed by the planning commission on June 8, 1993, and by the city council on July 6, 1993; and WHEREAS, it has been determined that the modified Facility will not impede the orderly development of adjacent properties nor unduly interfere with the City's use of the site for public purposes, NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Medina, Minnesota that an amended conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The Facility to be maintained by the Applicant may include an antenna tower, antennas and an accessory building. The antenna tower may not extend more than 30 feet above the top of the water tower. The Facility may include not more than 12 Antel LPD 7905 / 8 antennas; 2. All construction on the site shall conform to city performance standards; 3. The Facility shall be modified and operated in compliance with the standards of the Federal Communications Commission; RHB56542 ME230-63 4. The Facility shall not utilize guy wires or lights on the tower or antennas; 5. The Applicant shall be responsible for snow removal and general maintenance of its portion of the driveway leading to the accessory building; 6. The Applicant shall maintain the accessory building, fence and the landscaping within the fenced area during the term of the lease. 7. The Applicant shall reimburse the City for all expenses it has incurred in reviewing this amended conditional use application and in renegotiating the lease for the property. 8. Any violation of the terms of this conditional use permit shall be grounds for revocation thereof and for termination of the lease for the Facility. 9. This amended conditional use permit is conditioned upon execution by the Applicant and the City of a lease. Termination of the lease for any reason shall be grounds for revocation of this conditional use permit. DATED: August 17 , 1993 Anil./6.
