HomeMy Public PortalAboutORD14580 Substitute by Councilman Struemph BILL NO. 2009-64 SPONSORED BY COUNCILMAN STRUEMPH ORDINANCE NO. /*.1 �p AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A PRELIMINARY PUD PLAN FOR 18.44 ACRES LOCATED IN THE 2600 BLOCK OF DREW PERRY ROAD, CONSISTING OF LOTS 1 THROUGH 20 OF SCHELLRIDGE NORTH SUBDIVISION, BEING A PART OF SECTION 2, TOWNSHIP 44 NORTH, RANGE 12 WEST, JEFFERSON CITY, COLE COUNTY, MISSOURI WHEREAS, JK Limited, LLC, owners of the real estate hereinafter described, being located in Jefferson City, Cole County, Missouri, and more particularly described as follows: Lots 1 through 20 of Schellridge North Subdivision, as per plat of record in Plat Book 12, page 567, Cole County Recorder's Office, being a part of the Southwest Quarter of Section 2, Township 44 North, Range 12 West, City of Jefferson, Cole County, Missouri; and the adjacent Drew Perry Road right of way. Consisting of 18.44 acres; and WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning have in all matters been complied with, as said property owner submitted to the Planning and Zoning Commission and City Council a Preliminary PUD Plan for the above referenced property. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. The Preliminary PUD Plan (Attached as Exhibit 1) submitted by Central Missouri Professional Services, Consultant, on file as Case No. P09021 in the Jefferson City Planning Division is hereby approved for the above land referenced herein with the following conditions: a. Setback areas of 50 feet shall be established along the southern and western property lines. No structures, accessory structures, patios, or driveways shall be located within the 50 feet setback area along the southern and western property lines. b. Building exterior finishes shall consist of 100% brick and rock veneer on the front, excluding architectural features such as doors, windows, and dormers and shall consist of not less than 80% brick and rock veneer on the rear portions of the structure, excluding sun porches . c. Maximum density shall be established as 40 residential units and 20 primary structures for the 18.44 acre PUD area. d. Each of the two proposed signs shall have maximum sign structure dimensions of 8' long, 4' tall, and 2' wide with maximum signage areas of 32 square feet. The signs shall not be illuminated. e. Maximum building height shall be established as 35 feet. f. Incorporation of the Declaration of Covenants,Conditions, Easements and Restrictions (Attached as Exhibit 2)and By-Laws of the Orchard at Schellridge Owner's Association (Attached as Exhibit 3) into the Preliminary PUD Plan. g_ The name of the subdivision shall be "The Orchards". h. No trees of greater than 6 inches in diameter shall be removed from a twenty-five foot buffer area on the south and west sides of the subdivision. SECTION 2. Common Areas and Public Land. Common areas for use by the owners within the development shall be as defined in the Declaration of Covenants, Conditions, Easements, and Restrictions. No common areas are dedicated to public use with this PUD Plan. SECTION 3. This ordinance shall be in full force and effect from and after the date of its passage and approval.
