CITY OF MEDINA
RESOLUTION NO. 93-53
RESOLUTION GRANTING AN AMENDED CONDITIONAL
USE PERMIT TO ROBERT BRADLEY FOR ACCESSORY
STRUCTURES EXCEEDING THE NUMBER AND SIZE
PERMITTED
WHEREAS, Robert Bradley (Applicant) is the owner of the property located
at 3000 Hamel Road; and
WHEREAS, the city council of the City of Medina (City) adopted Resolution No.
92-102 on November 17, 1992 granting permission for more and larger accessory
structures on the Applicant's property than is authorized as of right under the
zoning ordinance; and
WHEREAS, the Applicant wishes to amend his conditional use permit to allow
an enlargement of one of the accessory structures; and
WHEREAS, the planning commission and city council have reviewed the
Applicant's request and have determined that granting the amended conditional use
permit to the Applicant will not adversely affect the development of adjacent
properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina that an amended conditional use permit be granted to the Applicant for the
stated purpose, subject to the following conditions:
1. The three accessory structures may not exceed an aggregate foot print
of 17,000 square feet and may not exceed a total of 23,500 square feet.
The hay and equipment building may not exceed 4,000 square feet;
2. The accessory structure may be used for keeping horses and as a
garage/storage facility incidental to the horses. The use is solely
accessory to the use of the property for single family residential uses
and no commercial use may be made of the site or structure;
3. The apartment located in barn is for the use of the Applicant's family
or hired help only;

4. The kennel and storage building are for personal use only. No
commercial use of the structures or site is permitted;
5. The Applicant shall pay to the city an administrative fee in an amount
sufficient to reimburse the city for its costs in reviewing this
application; and
6. This resolution supersedes Resolution 92-102.
BE IT FURTHER RESOLVED by the City of Medina, Minnesota that the City's
willingness to grant this amended conditional use permit for three accessory
structures containing up to 23,500 square feet is solely due to the size of the
Applicant's property (approximately 188 acres) and that the City reserves the right
to review this conditional use permit upon subdivision of the Applicant's property.
The right to review this conditional use permit includes the right to modify the
conditions under which it is issued or to revoke it if warranted in the opinion of the
City.

The motion for the foregoing resolution was duly seconded by member
Philip Zietlow and upon vote being taken thereon, the following voted in favor
thereof: Councilmembers Ferris, Zietlow and Ann Thies
and the following voted against same: None
Absent: Councilmember James Johnson and Mayor Anne Theis
Whereupon said resolution was declared duly passed and adopted.
