HomeMy Public PortalAbout77-049 (06-07-77)_ ..S I;'. 1~ESOLUTION N0: 77-~+9 A RESOLUTION OF' THE CITY' COUNCIL OF THE CITY OF LYNWOOTa, CALIFORNIA, AUTHORIZING THE ADJUSTMENT AND .SETTLEMENT OF CLAIMS AGAINST THE CITY. WHEREAS, the City has retained an independent adjustor - and L'nvestigative service for claims filed against it.; and WHEREAS; for the expedient settl.cment of claims ncessary to minirnize costs of the C~.ty„ it 3.s necessary that the staff and the adjustor have specified authority nn behalf of the City to immediately enter into Settlement Agreements witklout prior authorization of the Council; NOW, THEREFORE, '1~HE CITY COUNCIL OF THE CITY OF LYNWOOD, CALT~OI~NIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. Upon investigation and determination by the adjustor for the City that- the City is partially or fully liable by reason of an incident or accident resulting in a claim against .the City, the adjustor shall have the authority to enter into Settlement Agreements on claims that do .not exceed Five hundred and no/lOOths ($500.00) Dollars. ~1'his authority may be suspended or reduced at any time by the City Manager or his designated agent. Section 2. When a claim against the City exceeds Five Hundred and no/100ths ($500.00) lJollars and it is determined that the City is partially or fully liable on the claim, the City~Manager or his designated agent, with the concurrence of . the City Attorney, shall have the authority to enter into a Settlement Agreement to settle the cid.im up to the amount of Five Thousand and nn/100ths (t~5,000.00) Dollars. 'Any such Settlement Agreement shall be signed by both the City Managers ' or his designated agent, and the City Attorney. ~, .~ ~. ., ., Section 3. All proposed settlements of claims~in which the staff cannot reach concurrences to settle as provided in Sect~_on 2, or which amount to Five Thousand and no/100ths ($5,000.00) Dollars or more, shall be referred to the City Council for determination. Section 4, The claims adjustor employed by the City shall be authorized to reject any claim filed against the City pursuant to and on the appropriate grounds set forth. in Title l; Division 3,6, Part 3, Chapter 2 of the Government Code of the State of California.
