CITY COUNCIL
MINUTES
JANUARY 5, 1982
INITIATION:
I 1. CALL TO ORDER:
.
Mayor Merritt called the regular meeting of the City Council to
order at 7:32 p.m. on Tuesday, January 5, 1982, in the Council
Chamber of the City Hall.
2. The invocation was given by Reverend Paul Montoya, St. Luke's Catholic
Church, 9451 E. Broadway.
3. The Pledge of Allegiance to the Flag was led by Mayor Merritt.
4. CALL:
Present: Councilmen- Atkins, Dennis, Gillanders, Tyrell, Merritt
Absent: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin, Assistant
City Manager Kimbrough, Planning Director Shaw, Chief
McCann, Fire Department, and Julie Estrada, Temple
City Times
5. CONSENT CALENDAR:
City Manager Koski requested Item G be removed from the Consent
Calendar. Staff has prepared a memo proposing candidate's filing
for the 1982 Municipal Election pay a deposit, which Council may
wish to consider along with the resolution.
Councilman Atkins moved to approve Items A through F, and Items
H and I as recommended, seconded by Councilman Dennis and carried.
A. APPROVAL OF MINUTES: Regular Meeting of December 15, 1981
Approved as written.
B. RECOMMENDATION FROM PARKS & RECREATION COMMISSION - Meeting of
December 16, 1981 - REQUEST FOR RESERVED USE OF TENNIS COURTS
Approved request from Temple City Unified School District for use
of seven tennis courts at Live Oak Park to conduct the Rio Hondo
League Boys Tennis Pre -lims and Finals on May 11 and 12, 1982 from
12:30 to 4:30 p.m., subject to the insurance requirements.
C. CIVIL RIGHTS INDEMNITY
Extended indemnification for civil rights and anti -trust actions
indefinitely to such time as the courts have identified the exposures
to which City officials are open and insurance carriers cover such
actions under their policies.
D. APPROVAL OF FINAL MAP NO. 39984 - 6042 -44 TEMPLE CITY BOULEVARD
Approved final map; accepted abandonment and /or restriction of access
rights as offered for dedication; found the project will not violate
any of the provisions of the Subdivision Map Act; and instructed the
City Clerk to endorse on the face of the map Council's approval.
E. ACCEPTANCE OF WORK - SLURRY SEAL OVER CHIP SEAL
Accepted the work performed in accordance with specifications and
authorized payment to Pavement Coatings in the amount of $12,705.46;
authorized filing Notice of Completion and release of the 10%
retention at the end of the 35 -day lien period.

F. RESOLUTION NO. 82 -2036: APPOINTING CITY TREASURER
Adopted Resolution No. 82 -2036 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY APPOINTING THE CITY TREASURER, appointing
Joan Downey as an official action.
H. RESOLUTION NO. 82 -2038: EMPLOYMENT OF PERSONNEL
Adopted Resolution No. 82 -2038 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY APPOINTING PERSONNEL.
I. RESOLUTION NO. 82 -2039: WARRANTS AND DEMANDS
Adopted Resolution No. 82 -2039 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF
$132,043.58, DEMAND NOS. 3211 THRU 3317.

CONSENT CALENDAR ITEM G - RESOLUTION NO. 82 -2037: PERTAINING TO
COSTS FOR CANDIDATE STATEMENTS
City Manager Koski stated that` pursuant. °to Section 3 of subject
resolution, staff estimates the total cost for including candidate's
statements to be included in the voter's pamphlet will be approximately
$700. This could change depending on the number of candidates
filing and how many elect to file a statement of qualifications.
He recommended an advance deposit by candidate's wishing to include
a statement of $250.00. Costs in excess would be billed to the
candidate, any deposits in excess of costs would be refunded.
Councilman Atkins moved to adopt Resolution No. 82 -2037 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPTING REGULATIONS
FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO COSTS OF MATERIALS
SUBMITTED TO THE ELECTORATE FOR THE GENERAL MUNICIPAL ELECTION TO BE
HELD ON TUESDAY, APRIL 13, 1982, seconded by Councilman Tyrell and
carried.
Councilman Tyrell moved to approve a deposit of $250.00 as a conditi III
of including candidate's statement in the voter's pamphlet, seconded
by Councilman Gillanders and carried.
Councilman Tyrell stated there was an unsuccessful candidate in 1980
who did not pay the total costs for printing candidate's statement
and moved to instruct the City Attorney to bring necessary action
to collect the amount due, seconded by Councilman Atkins and carried,
Councilman Gillanders abstaining.
6. UNFINISHED BUSINESS:
None.
7. NEW BUSINESS:
None.
8. COMMUNICATIONS:
A. Claims for Damages: From attorney representing ten clients.
City Manager Koski stated the city has received claims from
an attorney representing ten (10) clients whose claims were
made as a result of an alledged damage during an incident on
September 26, 1981 in San Gabriel.
Councilman Tyrell moved to deny and refer to JPIA, seconded by
Councilman Gillanders and carried.
9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:

RECESS TO CRA:
At this time Council recessed to meet as the Community Redevelopment Agency,
all members being present; and approved the minutes of the December 15, 1981
meeting. The minutes are set forth in full in the records of the Agency.
RECONVENE AS CITY COUNCIL:

11. MATTERS FROM CITY OFFICIALS:

A. City Manager's Spring Conference, Coronado, February 3 -5, 1982
Councilman Gillanders moved to approve City Manager's attendance
to subject conference and authorize necessary expenses, seconded
by Councilman Atkins and carried.
B. California Contract Cities 14th Annual Legislative Orientation
Tour, Sacramento, January 19 -21, 1982
Councilman Gillanders moved to authorize attendance by those City
Council members wishing to attend, and City Manager to subject
seminar, seconded by Councilman Tyrell and carried.
C. Employment of Administrative Analyst
City Manager Koski stated that 130 applications had been reviewed
for the position of Administrative Analyst; interviews of a
number of the applicants were conducted; and he recommended the
successful applicant be offered the position of Administrative
Analyst. Councilman Gillanders moved to approve, seconded by
Councilman Atkins and carried.
D. Councilman Gillanders stated the Southern California Joint Powers
Insurance Authority has requested the City's concurrence in the
addition of the Southeast Area Animal Control Authority to be in-
cluded in the benefits from JPIA. The SEAACA provides animal control
services to a large number of member cities and they are trying to
get their liability coverage in one package. Councilman Gillanders
stated animal control agencies are one of the largest generators of
workers compensation claims and liability claims. It may, . not have
an immediate impact but ultimately the amount of staff just to handle
their claims will raise the costs to member cities. Councilman
Gillanders requested Council's decision before taking any action on
behalf of the city.
Councilman Tyrell expressed the concern that it is becoming increasingly
necessary for animal control officers to be armed, many without
sufficient training, which could lead to expanded liability coverage
under JPIA. He also expressed concern for lack of control by the
individual cities in the authority.
Councilman Dennis stated if the cities who are part of the JPIA had
their own animal control they would be covered under that; however,
his concern is those cities who are not now included in the JPIA.
Mayor Merritt stated he did not feel this type of agency was originall.
intended to be included in JPIA.
Councilman Tyrell moved to instruct Councilman Gillanders to vote
against inclusion of the SEAACA in JPIA, seconded by Councilman
Atkins and carried.
E. Councilman Dennis stated that City Manager Koski is the alternate
to the San Gabriel Valley Animal Control Authority and because of
occasional conflicts there are times when neither the delegate nor
the alternate can attend meetings and suggested another alternate
be appointed.

Councilman Gillanders moved to appoint Assistant City Manager
Stephen Kimbrough alternate to the Authority, seconded by Councilman
Atkins and carried.
F. Councilman Gillanders stated SB 33 has been revived in the
legislature, it being the bill which would require annual inspection
of motor vehicles. He has not seen any appreciable change and has
communicated with Senator Richardson and encouraged other council
members to also write.
Councilman Gillanders also stated that on his recent vacation he
had the opportunity to review transportation systems. He will make
a report to the Senate Committee on Transportation, but stated he
was not impressed with what he saw. He did state Sydney, Australia
has a system similar to the old red cars.
12. ADJOURNMENT:
On motion by Councilman Tyrell, seconded by Councilman Atkins,
meeting adjourned at 8 p.m. Next regular meeting of the City Council
will be held Tuesday, January 19, 1982, 7:30 p.m. in the Council
Chamber of the City Hall.
