RESOLUTION N0. 77-71
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD APPROVING OF AiVD MAKING APPLICATION FOR
'rHE DISABILITY RETIREMENT OF LYPJWOOD CITY EMPLOYEE
WILLIAM D. ELLIOTT PURSUANT TO SECTIONS 21024 AND
21025 OF THE GOVERNMENT CODE.
WHEREAS, the City of Lynwood (herei.nafter referred to as
"Agency") is a contracting agency of the Public Employees'
Retirement System; and
WHEREAS, the Public Employees' Retirement Law requires
that a contracting agency determine whether an employee of such
agency in employment in which he is classified as a local safety
member is disabled for purposes of the Public Employees' Reitre-
ment Law and whether such disability is "Industrial" within fhe
meaning of such law; and
WHEREAS, the City of Lynwood has reviewed the medical and
other evidence relevant to such alleged disability.
NOW, THEREFORE, BE IT RESOLVED, that the City of Lynwood
find and determine, and it does hereby find and determine that
WILLIAM D. ELLIOTT is incapacitated within the meaning of the
Public Employees' Retirement Law for performance of his duties
in the position of Police Officer and establish October 1, 1977
as his effective date of retirement; and
BE IT FURTHER RESOLVED tiZat the City of Lynwood hereby
makes application for the disability retirement of WILLIAM D.
ELLIOTT and authorizes and directs its appropriate officers
__._____ __to execute all.-documents necessary-and convenient therefor; - -
and
BE IT FURTHER RESOLV~;D that the City of Lynwood find and
determine and it does hereby find and determine that such
disability is a result of injury or disease arising out of and
in the course of employment.
PASSED, APPROVED AND ADOPTED this 2nd day of August, 1977,
