A RESOLUTION OF THE CITY GOUi~TCIL OF THE CITY OF
LYNWOOD APPROVING Or' Ai~iD PQP.KING APPLICATION FOR
THE DISABILITY RETIt~.EMENT OF LYNGJOGD CITY EMPLOYEE
BILLY G. HEr'LEY PURSUANT TO SECTIONS 21024 AND
21025 OF ~S'HE GOVERNi~IEiv`1~ CGDE.
WHEREAS, the City cf Lynwood (hereinafter referred to as
"Agency") is a contracting ageizcy ~f the Public Employees`
Retirement System; and
WHEREAS, the Public Employees' Retireme:~t Law requires
that a contracting agency determine vahether an emp]_oyee of
such. agency in employment in which he is classified as a 1cca1
safety mernbcr is disabled for purposes o.f the Public Employees'
Retirement Law and whether. such disability is "Industria.l"
within the meaning of such law; and
WHEREAS, the City of Lynwood has reviewed the medica]_
and other evidence re7_evant to such a1l.eged disability.
NOW, THEREFORE, BE IT RESOLVED, that the City of Lynwood
find and determine, and i.t does hereby find and determine that
BILLY G. HEFLEY is incapacitated within the meaning of. tree
Public Employees' Retirement Law for performance of his duties
in the position of Police Officer and establish October 1, 1977
as his effective date of retirement; and
BE T.T FURTHER RESOLVED that the City of Lynwood hereby
- - - makes-application for the disability retirement of BILLY G.
HEFLEY and authorizes anal directs its appropriate officers
to execute all documents necessary and convenient therefor;
and
BE IT FURTHER RESOLVED that the City of Lynwood find and
determine and it does hereby find and determine that such
disability is a result of injury or disease arising out of and
in the course of employment.
PASSED, APPROVED AND ADOPTED this 2nd day of August, 1977.
