HomeMy Public PortalAbout1993-063Member Ann Thies adoption: introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO. 93-63 RESOLUTION GRANTING FINAL APPROVAL FOR WALNUT BAY WHEREAS, Mark L. Klingelhoets and Gwen M. Klingelhoets are the owners (collectively, "Applicants") of Lots 1-4, Block 31, Independence Beach, Hennepin County, Minnesota (the "Subject Property); and WHEREAS, the Applicants have proposed to replat the Subject Property into two lots to be known as the plat of Walnut Bay; and WHEREAS, the proposed plat has been reviewed by the planning commission and by the city council for compliance with the subdivision regulations of the city and found to be in compliance therewith. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that final approval is hereby granted for Walnut Bay, subject to the following conditions: 1. All grading must be completed on both Lots 1 and 2, Block 1 prior to beginning construction on a house on either lot. The grading work shall include construction of a sodded drainage swale and a silt fence; 2. The screen porch located on Lot 2, Block 1 must be structurally improved to the satisfaction of the city building inspector by no later than October 1, 1993; 3. The parties recognize and acknowledge that the screen porch on Lot 2, Block 1 is a non -conforming structure which is subject to the city's non- conforming use ordinance; 4. The screen porch located on Lot 2, Block 1 must be removed if construction of a primary structure on that lot has not commenced within two years of the date of approval of this resolution; 5. The Applicants must pay a park dedication fee for Lot 2, Block 1 in the amount determined by city staff; RH858547 ME230-182 6. The Applicants must file the final plat with Hennepin county within 60 days of the date of this resolution, after which time this resolution shall be null and void and the approval granted herein shall lapse; and 7. The Applicants must pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city for reviewing the plat.
