HomeMy Public PortalAbout1993-067Member Ann Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 93-67 RESOLUTION GRANTING CONDITIONAL USE PERMIT TO C . C . & M PARTNERSHIP WHEREAS, C. C. & M Partnership (Applicant) has requested permission to operate an office for a construction business at the property located at 300 T . H . 55 ; and WHEREAS, the proposed use requires a conditional use permit under the city's zoning ordinance; and WHEREAS, the planning commission reviewed the request on August 10, 1993 and the city council reviewed the application on September 7, 1993 and September 21, 1993; and WHEREAS, the city council determined that the proposed office use would not interfere with the development of adjacent property. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for a construction business office but not for a flea market or auto flea market, subject to the following conditions; 1. The southern part of the driveway must be removed to the extent that it cannot be used for traffic; 2. The signs at the entrance must conform to the city's sign ordinance; 3. The miscellaneous items in the northwest corner of the site must be removed from the property; 4. The ticket structure and all debris must be removed from the property; 5. The two sets of stairs located near the berm must be removed from the property; 6. The pipe on top of the berm must be removed from the property; RHB59300 ME230-192 7. The fencing in the northwest and southeast corners of the site must be removed from the property or reconstructed; 8. The drive-in screen and all debris associated therewith and the playground equipment must be removed from the property; 9. All of the above items which must be removed or repaired must be accomplished prior to April 1, 1994; 10. All exterior lighting must be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property; 11. The office building must meet fire and building codes; 12. There may be no more than eight construction trailers on site and they must be located in the northeast quadrant as shown on the site plan submitted to the city. No other outside storage shall be permitted on the site; 13. The applicant must correct any hazardous conditions regarding the parking area determined to exist by the city engineer; 14. No part of any commercial or industrial building on the site may be occupied as a residence; 15. Hours of operation shall be limited to 6:00 a.m. to 6:00 p.m. , Monday through Saturday; 16. The number of employees shall not exceed 10; 17. The applicant shall make all drainage improvements and grant any easements determined necessary by the city engineer; 18. The building and all activities on the site must meet the requirements of the Hamel Fire Department; 19. Handicapped parking must be provided in accordance with state law; 20. The above ground propane tanks on the site must be screened from view from adjacent properties; and 21. The applicant must pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city for reviewing this conditional use permit.
