CITY OF TEMPLE CITY CITY COUNCIL MINUTES JANUARY 19, 1982 Mayor Merritt called the regular meeting of the City Council to order at 7:33 p.m. on Tuesday, January 19, 1982, in the Council Chamber of the City Hall. The invocation was given by Reverend Albert Frederico, Seventh Day Adventist, 9664 E. Broadway. 3. The Pledge of Allegiance to the Flag was led by Mayor Merritt. 4. ROLL CALL: Present: Absent: Also Present: Councilmen- Atkins, Dennis, Gillanders, Tyrell, Merritt Councilmen -None City Manager Koski, City Attorney Martin, Assistant City Manager Kimbrough, Planning Director Shaw, Fire Chief McCann, and Julie Estrada, Temple City Times 5. CONSENT CALENDAR: Mayor Merritt requested Items D(1) and (2) and H be removed from the Consent Calendar. Councilman Atkins moved to approve Items A through C, and E through G as recommended, seconded by Councilman Gillanders and carried. A. APPROVAL OF MINUTES: Regular Meeting of January 5, 1982 Approved as written. B. RECOMMENDATION FROM TRAFFIC COMMISSION - Meeting of January 6, 1982 TIME LIMIT PARKING, 5912 ENCINITA AVENUE Approved posting of signs with the appropriate arrows on the east side of Encinita Avenue south of Hermosa Drive reading "2 Hour Parking 7 A.M. to 6 P.M., Sundays Excepted ". C. PLANNING COMMISSION ACTION: Meeting of January 12, 1982 Received and filed memo relating to action taken by the Planning Commission at their regular meeting held January 12, 1982. E. ACCEPTANCE OF SANITARY SEWERS: TRACT NO. 37579 HALIFAX /FREER /ARDEN /HALLOWELL Approved the work completed and released the Sanitary Sewer Agree- ment between the City and the subdivider, and released the Faithful Performance Bond in the amount of $40,000.00. F. CLARIFICATION OF FINAL PLANS - MODIFICATION OF ZONE VARIANCE CASE 79 -565, B.B. BENDER, 9094 LAS TUNAS DRIVE Approved final plans with clarification the fire ratings of the floors and ceilings shall be reduced from 2 hour to 1 hour, and the number of roll -up doors on the easterly and northerly elevations reduced to one roll -up door on each elevation. F. RESOLUTION NO. 82 -2040: EMPLOYMENT OF PERSONNEL Adopted Resolution No. 82 -2040 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL. Council Minutes, January 19, 1982 - Page 2 CONSENT CALENDAR ITEM D - RECOMMENDATIONS FROM PARKING COMMISSION - MEETING OF JANUARY 13, 1982 Mayor Merritt stated he has observed periodically a vehicle parked on the mall at 9510 Las Tunas Drive during various times of the day and evening, and requested the condition regarding prohibition of storage of vehicles be emphasized in the letter transmitting the renewal. Councilman Gillanders inquired about the requirements for liability coverage, stating he felt the amount was not adequate. Councilman Tyrell stated the amount has not changed since the original agree- ments approximately 10 years ago and agreed they are inadequate and suggested the amounts be changed to $200,000 each person and $500,000 each occurrence for bodily injury and property damage liability. (1) RENEWAL OF AGREEMENT TO CROSS OVER PEDESTRIAN MALL, Zager -Smith Carpet Company, 9510 Las Tunas Drive Councilman Atkins moved to approve renewal of agreement to March 1, 1983, subject to all conditions set forth in staff memo dated January 14, 1982 and amending Item #5 to require bodily injury and property damage liability coverage limits of $200,000 each person, $500,000 each occurrence, seconded by Councilman Gillanders and carried. (2) RENEWAL OF AGREEMENT TO CROSS OVER PEDESTRIAN MALL, A. W. Driver, 9611 Las Tunas Drive Councilman Atkins moved to approve renewal of agreement to March 8, 1983, subject to all conditions set forth in staff memo dated January 14, 1982, and amending Item #4 to require bodily injury and property damage liability coverage limits of $200,000 each person, $500,000 each occurrence, seconded by Councilman Gillanders and carried. CONSENT CALENDAR ITEM H - RESOLUTION NO. 82 -2041: WARRANTS & DEMANDS Mayor Merritt inquired about collection of ambulance bills, stating it would appear from the warrants that the service cost the city somewhere around $10,000 to $15,000 annually. City Manager Koski stated the city's collection rate is about 10% of those we bill which is after the ambulance company and the county have tried to collect. Councilman Tyrell stated the city has a large proportion of senior citizens and many calls for ambulance service are for people who are on Social Security and cannot afford to pay and he feels the city has a certain obligation here. Councilman RESOLUTION CLAIMS AND THRU 3412, Gillanders moved to adopt Resolution No. 82 -2041 A OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING DEMANDS IN THE SUM OF $164,293.87, DEMAND NOS. 3318 seconded by Mayor Merritt and carried. 6. UNFINISHED BUSINESS: A. PUBLIC HEARING: UNPAID ASSESSMENT - UNDERGROUND UTILITY DISTRICT NO. 4 City Manager Koski presented background, stating the City Council at their regular meeting held November 17, 1981, set public hearing for January 19 as the time and place for hearing protests against assessments of cost to provide underground utilities within Underground Utility District No. 4. There is one outstanding assessment for property located at 9133 Las Tunas Drive. If Council confirms the assessment the property owner will have five day to pay the assessment or it becomes a lien on the property. Council Minutes, January 19, 1982 - Page 3 Mayor Merritt declared the public hearing open and invited anyone wishing to speak to the subject to come forward. There being no one come forward to speak, Councilman Tyrell move to close the public hearing, seconded by Councilman Atkins and carried. Councilman Tyrell moved to affirm the assessment of $500 to property located at 9133 Las Tunas Drive to provide underground utilities within Underground Utility District No. 4, seconded by Councilman Atkins and carried. 7. NEW BUSINESS: None. 8. COMMUNICATIONS: A. Kiwanis Club Request for Annual Line of Dimes Campaign - January 29, 1982, 11:30 a.m. to 5:30 p.m. Councilman Tyrell moved to approve the request by Kiwanis Club to conduct their annual Line of Dimes campaign at the intersection of Las Tunas Drive and Temple City Boulevard on January 29 from 11:30 a.m. to 5:30 p.m., subject to the required Certificate of Insurance, seconded by Councilman Gillanders and carried. B. Claims for Damages: From attorney representing ten clients. City Manager Koski stated the City has received three claims on behalf of clients alleging damage during an incident on September 26, 1981 in San Gabriel. Councilman Tyrell moved to deny claimsand refer to JPIA, seconded by Councilman Gillanders and carried. C. Falcon Communications City Manager Koski presented a communication from Falcon Communi- cations advising of the reorganization of Falcon Communications and requesting Council's review and action. Councilman Dennis moved to refer the matter to the City Attorney for review . and recommendation, seconded by Councilman Gillanders and carried. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Charles Roth, 9415 Camino Real, requested Council to reconsider installation of sidewalk on the north side of Camino Real citing heavy and fast traffic in the morning, at noon, and after school by both students and parents. He stated he had been contacted in July by the City advising of the proposal for sidewalks, curb and gutter on the north and south side of Camino Real; he had agreed to pay one -half of the project and learned only recently sidewalks were not going to be installed on the north side. Councilman Dennis stated he supported installation of sidewalk at the public hearing and he has not changed his thinking. Councilman Tyrell stated in view of the letter from the City which said in effect that the project would be undertaken upon property owner's agreement to assume his share of curb and gutter, he would withdraw his objection. Councilman Gillanders stated he also would withdraw his objection based on the wording of the letter which Council had not previously seen. Councilman Dennis moved to approve installation of sidewalk on the north side of Camino Real, seconded by Councilman Atkins and carried unanimously. Council Minutes, January 19, 1982 - Page 4 Mrs. Lucille Provine, 6238 Primrose Avenue, stated she had received a letter from the City Attorney requesting payment for printing charges for Candidate's statement in the 1980 election; she had responded outlining her reasons why she does not feel all of the costs should be passed on to her and making a compromise offer to pay one -half, or $350 of which $130 would still be owing. City Attorney, in answer to question from Council, stated a settlement would be in the best interests of the City, rather than the costs involved in collecting the remainder. Mrs. Provine stated that the estimate increased threefold which is not reasonable and it should have been protested to the supplier. Councilman Tyrell stated the estimates are based on the expectation more than one person desires a statement printed and the price goes down with each one. Candidates know that if they are the sole candidate filing a statement the entire cost goes to them. He also stated that having been in the City Clerk's office, Mrs. Provine knows better than most how the system works. He feels it is improper to ask for a reduction, however the City Attorney has advised it would serve no financial purpose to pursue this and he'would not oppose a settlement. Councilman Tyrell moved to accept the counteroffer to pay $130 . for a total of $350 which is one -half the printing costs, seconded by Councilman Gillanders and carried. RECESS TO CRA: At this time Council recessed to meet as the Community Redevelopment Agency, all members being present; and approved the minutes of the January 5, 1982 meeting. The minutes are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: 10. ACTION ON REQUEST BY CRA: There was no action to be taken. 11. MATTERS FROM CITY OFFICIALS: A. Request to Attend California Parks & Recreation Society Conference - Sacramento, March 5 -7, 1982 Councilman Dennis moved to approve request from Director of Parks and Recreation to attend subject conference and authorize the necessary expenses, seconded by Councilman Atkins and carried. B. Mayor Merritt stated that he has witnessed north and south bound traffic buzz around pedestrians in the crosswalk at Temple City Boulevard and Woodruff and requested the Traffic Commission make an investigation and recommendation how to cure the problem. 12. ADJOURNMENT: On motion by Councilman Gillanders, seconded by Councilman Dennis, meeting adjourned at 8:06 p.m. The next regular meeting of the City Council will be held Tuesday, February 2, 1982, 7:30 p.m. in the Council Chamber of the City Hall.
