HomeMy Public PortalAbout1993-070Member John Ferris introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 93-70 RESOLUTION ADOPTING SUPPLEMENTAL ASSESSMENT ROLL FOR IMPROVEMENT OF MEDINA ROAD WHEREAS, it has been proposed to improve Medina Road between Hunter Drive and Tamarack Drive by placement of stabilization fabric, drain tile and 12 inches of gravel base and 42 inches of bituminous surfacing 24 feet in width with 6 foot gravel shoulders; and WHEREAS, pursuant to published and mailed notice thereof, a public hearing on the assessment of said improvement project was held before the city council on February 2, 1993; and WHEREAS, Galen L. Bruer and Annamarie A. Daley are the fee owners of Lot 6, Block 1, Tuckborough Farm Fifth Addition, Hennepin County, Minnesota (the "Property") ; and WHEREAS, the Property was assessed $4,615 for the cost of the improvement of the Medina Road pursuant to the resolution adopted by the city council on February 2, 1993; and WHEREAS, following an appeal, the parties have reached an agreement regarding a reduction in the assessment to be levied against the Property; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota as follows: 1. The supplemental assessment roll, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute a special assessment RHH48625 ME230-167 against the Property, which is hereby found to be benefitted by the improvement in the amount of the assessment levied against it. 2. The assessment shall be payable in equal annual assessments extended over a period of 10 years, the first of the installments to be payable on or before the first Monday in January, 1994, and shall bear interest at the rate of 8 percent per annum from the date of the adoption of this supplemental assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1994. To each subsequent installment when due shall be added interest for one year on all unpaid installments . 3. The owners of the Property may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on the Property, with interest accrued to the date of payment, to the city clerk -treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the city clerk -treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The city clerk -treasurer is authorized and directed to transmit a certified copy of this assessment to the county auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes . 5. This resolution supersedes the assessment roll adopted on February 2, 1993, only with regard to the Property and shall not affect any other assessment levied as a result of action by the city council on said date regarding the Medina Road improvement project .
