HomeMy Public PortalAbout13-8648 Trade (SWAP) Properties Located at James and Washington Street Sponsored by: City Manager RESOLUTION NO. 13-8648 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, TO AUTHORIZE THE CITY MANAGER TO TRADE (SWAP) PROPERTIES LOCATED AT JAMES AND WASHINGTON STREETS ALSO KNOWN AS THE "WASHINGTON STREET TOT LOTS",FOLIO NOS 08-2122-003- 1580, 08-2122-003-1670, AND 082122-003-1690, IN EXCHANGE FOR PROPERTY LOCATED AT 2081 LINCOLN AVENUE, FOLIO NO.08-2122-003-0350,CURRENTLY OWNED BY MIAMI- DADE COUNTY HABITAT FOR HUMANITY; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS,the Opa-locka Community Development Corporation("OLCDC")is requesting the City trade properties located at James and Washington Streets also known as the "Washington Street Tot Lots", Folio Nos. 08-2122-003-1580, 08-2122-003-1670, and 082122-003-1690, in exchange for property located at 2081 Lincoln Avenue, Folio No. 08-2122-003-0350; and WHEREAS, the property to be acquired by the City is currently owned by Habitat for Humanity, but is being conveyed to Miami-Dade County; and WHEREAS, the OLCDC desires the property swap with Miami-Dade County for redevelopment of the Magnolia subdivision; and WHEREAS,pursuant to Resolution 11-8184,the City Manager is authorized to work with OLCDC in partnership through in-kind contribution of property owned by the City; and WHEREAS,Miami-Dade County has provided$3.4 million in cash and in-kind donation of county-owned property; and Resolution No. 13-8648 WHEREAS,the OLCDC and the City have concluded that Washington Street Tot Lots are inadequate for City use; and WHEREAS,pursuant to Resolution 08-7317,and the City Manager evaluation,the property currently owned by the City should be disposed of, and traded for the property currently owned by Habitat for Humanity at 2081 Lincoln Avenue; and WHEREAS, the City Commission of the City of Opa-locka desires the City Manager to swap Folio Nos. 08-2122-003-1580, 08-2122-003-1670, and 082122-003-1690 for Folio No. 08- 2122-003-0350. NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka,hereby directs and authorizes the City Manager to trade(swap)properties located at James and Washington Streets also known as the"Washington Street Tot Lots",Folio Nos.08-2122-003158,08-2122-003-1670,and 082122-003- 1690,in exchange for property located at 2081 Lincoln Avenue,Folio No. 08-2122-0350,currently owned by Miami-Dade County/Habitat For Humanity. Section 3. This Resolution shall take effect immediately upon adoption. The subject property contains approximately three lots located near Washington and James Streets (See Attached legal descriptions). As you are aware, Resolution No. 11-8184 authorized the city manager and staff to work with OLCDC and part of that partnership insists upon the City's assistance through in-kind contribution through donation of property owned by the City of Opa-locka. To date, OLCDC plans to spend approximately 21 million dollars in and around Magnolia North, Magnolia Gardens, and 22nd Avenue Corridors; Miami-Dade County through Commissioner Barbara Jordan's office has provided approximately 3.4 million dollars in cash and in-kind donation of county-owned property. The Assistant City Manager and Community Development Director has been meeting with the OLCDC on a weekly basis to ensure that all actions endorsed by the Mayor and City Commission in Resolution 11-8184 is being executed. In the opinion of staff, the property has outlived its usefulness and has become inadequate for city use. The City staff spends approximately eight (8) hours per month maintaining this property every two weeks during the summer months with no immediate long term plans for city development. City Resolution No. 08-7317 requires the city manager to evaluate and make a good faith analysis of the property. The appropriate method to dispose of this property would be by trading (land swapping) the subject property with Miami- Dade County. There will be no surety bond requirement for this transaction. Should the city sell the subject property, the City Manager will advertise in a newspaper of general circulation as required by Resolution No. 08-7317 and other applicable laws. The City Attorney will execute and facilitate any action as required by Resolution No. 08-7317. Financial Impact: There is no financial impact other than for ordinary costs associated with real estate transactions. As per the resolution conveying these lots,Habitat was to build single family homes using the Habitat model. When my predecessor Anne Manning accepted these lots,it was our intention to build and sell these homes in the timeframe allotted by the resolution. Now,a few years later,Habitat finds itself in the position of not being able to complete this project. The reasons are varied,including cost and lack of resources.More importantly,however, is that despite several efforts,we have not had any interest in these lots by prospective homebuyers. Habitat only builds homes on sites that have been selected by families after completing a substantial-part of their sweat equity requirements. When presenting these lots to families in the Habitat system,they have shown a preference for other parts of Miami-Dade. The combination of factors pertaining to these lots has led our Board of Directors to instruct me to take the necessary steps to return these parcels to Miami Dade County. As such,I will be contacting Alan Eason of the infill housing program to begin this process. Some of these parcels are involved in"land swap"requests from entities such as the Opa-Locka CDC in order to secure land for uses such as parking or park-space as part of their master plan for Magnolia North.I believe that upon returning these lands to the County,this process will be dramatically simplified and will make re-development of the area a lot easier. For what it's worth,it is our opinion that multi-family construction would be far more compatible for the area and we would encourage that course of action moving forward. Commissioner Jordan, I am not proud of this return of land.Habitat takes it commitments very seriously, as evident in the successful completion of nearly 164 Liberty City homes in the last three years. Making this decision has been a difficult one and I personally apologize if we are letting you and the residents of Opa-Locka down. It is our desire to maintain our great relationship with your office and Miami Dade County and to continuing to serve the people of this community.
