RESOLUTION N0. 77-101
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD DECZARING THAT THE UNOCG~UPIED
STRUCTURES WITHIN THE 105 FREEWAY CORRIDOR
ARE A THREAT TO PUBLIC HEALTH AND SAFETY
WHEREAS, Assembly Bil`T 1833 was adopted by the
State Legislature and signed by the Governor of the State
of California as an urgency measure,. and,
WHEREAS, under said bill the Department of Trans-
portation of the State of California, is required to proceed
expeditiously to; remove or demolish or cause to be removed
or demolished, all structures that ar.e not lawfully occupied
and are a threat to public health and safety or have been de=
Glared a nuisance, or have been found to be hazardous and
unsafe pursuant to the C-ity's ordinances, or have. been found
by that City's legislative body to be a threat to public
health and safety, and,
WHEREAS, there. are 555 units in the 105 Freeway
Corridor within the .City limits of Lynwood; which are not law-
fully occupied and which have been continually damaged and
vandalized over the past five years and ar"e unsafe and a
threat to public health and safety, .and,
WHEREAS, the City of Lynwood condemns the decision
by the State of California Department of Transportation ruling
'~~ that a survey of said structures be made to determine health
arsd safety conditions before any court orders be ,granted for
demolition due to the fact that these structures have been a
target for arsonists, vandals and criminals since being vacated
and said°survey would merely prolong this adverse condition for-
an indefinite period.
NOW, THEREFORE, The City Council of the City of
Lynwood doe re-solve as follows
SECTION l That all structures as set forth in
Exhibit A hereof, withi the 105 Freeway Corridor in the
City of Lynwood that have been determined by this City's
legislativebody as a detriment to the safety and welfare of
its citizens and_ are not lawfully occupied, and hereby de-
Glared a nuisance
:SECTION 2 All units as set forth in Exhibit A
hereof within the 105 Freeway Corridor iri the City of Lynwood
have been found to be unsafe and hazardous in accordance with
the provisions of Chapter °21, Section 21-16 of the. City of
L;ynwoo~d T~unicipal Code .
SECTION 3 A,11 units as set forth in Exhibit A
hereof within the 1,05 Freeway Corridor in the City of Lynwood
are declared b,y the City Council of the City of Lynwood, to
be a threat to public health and safety because of numerous
w incidents of crime, vandalism, and fires, which have been
occurring among these structures since 1872
SECTION 4- The California Department of Transporta-
ton is hereby requested to expeditiously make such motions
before the Court having jurisdiction in order to authorize
prompt removal or demolition of said units, in accordance with
the.. provisions of Section 405 2 of the Streets and Highways Code
of the State of California
SECTION 5 The action requested hereby is solely for
the purpose of abating a serious threat. to the health and safety
of persons residing within or in the vicinity ~f the right of way

of Route 105 within the City of Lynwood and shall not be con-
strued as having any bearing on the eventual construction of
a freeway on Route 105, nor shall be construed as being pre-
paratory activities for such construction
SECTION 6 The California Department of Transporta-
tion is additionally requested to reconsider initiating the
corridor survey and focus their attention on the eventual d~e-
molition of these units which would be in the community's best
interest and welfare.
