COUNCIL MINUTES
February 22, 1983
The Council of Bal Harbour met Tuesday, February 22, 1983 at 9:30 A.M.
in the Village Hall.
Present: Messrs. Beatty, Printup, Sherman, Taplin and Miss Gray
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer,
Village Clerk; and Alan S. Gold, Village Attorney.
On motion of Miss Gray, seconded by Mr. Beatty, and voted the minutes
of January 25, 1983 were approved as submitted.
Mr. Maley reported that the plans for the Collins Avenue Bus Bay, new
sidewalk in front of the Bal Harbour Shops and a temporary sidewalk across
the triangle north of the Sun Bank, have been completed and are ready for
bid in accordance with the Council's direction. It was also reported that
Dade County will relocate the pedestrian crossing to a more appropriate
location south of the existing crosswalk. The plans were presented to the
Council. It was moved by Mr. Taplin, seconded by Mr. Beatty, and voted
that bids be obtained for the March meeting.
Mr. Maley and Mr. Douglas Ruth, Landscape Architect, presented a tentative
sketch for the bus shelters that would be placed at five of the nine bus
stop locations in Bal Harbour. Mr. Maley said he had asked Mr. Ruth to
prepare the sketch so that foundation supports for the structure could be
placed in the new Bus Bay location. The council discussed having an over all
design for Collins Avenue and 96th Street, including landscaping at the
bus shelters, the bus shelters, signing and street furniture similar to the
original plan done by Edward Durell Stone some years ago. It was suggested
that the Village Manager work with the Resort Tax Committee for input.
It was moved by Mr. Taplin, seconded by Miss Gray and voted that the Village
Manager contact some landscape architects including firms of Bozes, Ruth,
Stone, and Taft and have them come to the next meeting.
The council discussed the beach lighting project using fixtures
installed in landscape beds. As no decision could be reached regarding
these lights or the suggestion to light the beach from the oceanfront
buildings, it was decided to hold the project for some time in the future.
Mr. Maley said that the publishers of USA Today placed twenty-two
newspaper racks in the village, twenty of them on Collins Avenue.. We do
not have an ordinance regulating this. At a recent trip to Tallahassee
Mayor Printup and he attended a meeting regarding this problem as it applies
to many cities in Florida. Some of the Dade County cities are meeting this
morning to discuss the problem. Mr. Gold suggested that before we consider
an ordinace regulating newspaper racks that we determine the results of
the other meeting, and authorize the Village Manager to write representa-
tives of the paper and invtie them to the next meeting to discuss the
problem. He feels that we could specify special areas where the racks
could be placed. It was the feeling of the council and several people in
the area representing the hotel properties that the excessive number of
racks was only being used to advertise the paper. It was moved by Mr. Sherman,
seconded by Mr. Beatty, and voted that Mr. Gold should talk with the
attorneys for Ganat papers and invite them to the next meeting. Also that
an ordiance be prepared for consideration at that time.
Mr. Gutenstein of the Sheraton Hotel appeared to request a one-time
variance to the noise ordinance. He said that the Cuban Medical Association
was again meeting at the hotel and requested music on the hotel pool deck
until 2:00 A.M. on June 30, 1983. It was moved by Mr. Taplin, seconded
by Mr. Beatty and voted that the music be allowed until 1:00 A.M. for
their reception. Mr. Gutenstein said he would send a letter to the President
of the Balmoral Apartments and to the Singapore Hotel.
Mr. Maley said that Mrs. Esther Swartz had submitted her resignation from
the Library Advisory Board but would like to remain as the alternate. It
was suggested that if anyone knew of someone who would like to serve,
they contact Mr. Maley.
Mr. Sherman reminded the members that Bal Harbour was hosting the
Dade County League of Cities meeting on March 3rd at the Sheraton.

was adjourned at 11:00 A.M.
