AN ORDINANCE OF THE CITY OF McCALL, VALLEY COUNTY, IDAHO, RELATING
TO THE SEGREGATION OF ASSESSMENTS FOR LOCAL IMPROVEMENT DISTRICT
NO. 3; MAKING FINDINGS AND DETERMINATIONS; SETTING FORTH THE ORIGINAL
ASSESSMENT ROLL, THE DESCRIPTIONS OF ASSESSMENT PARCELS, AND THE
AMOUNT AND DATE OF THE ORIGINAL ASSESSMENTS FOR LOCAL IMPROVEMENT
DISTRICT NO. 3; PROVIDING FOR THE SEGREGATION OF ASSESSMENTS FOR
ASSESSMENT PARCELS G AND I, WITHIN LOCAL IMPROVEMENT DISTRICT NO. 3
AND WITHIN THE ASPEN RIDGE SUBDIVISION NO. 3; PROVIDING FOR THE
PAYMENT OF REASONABLE ENGINEERING AND CLERICAL COSTS INCIDENT TO
THIS SEGREGATION; DIRECTING THE CITY CLERK TO MAKE THE SEGREGATION
OF ASSESSMENTS ON THE ASSESSMENT ROLL; SETTING FORTH THE REVISED
ASSESSMENT ROLL FOR LOCAL IMPROVEMENT DISTRICT NO. 3, INCLUDING ALL
AMENDMENTS THERETO AND SEGREGATIONS OF ASSESSMENTS THEREON AND
PROVIDING FOR THE PAYOFF OF SEGREGATED ASSESSMENTS; RATIFYING
PREVIOUS ACTIONS; DIRECTING THAT A CERTIFIED COPY OF THIS ORDINANCE
BE FILED WITH THE RECORDER OF VALLEY COUNTY, IDAHO; PROVIDING FOR
PUBLICATION OF A SUMMARY OF THIS ORDINANCE; AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, by adoption of Ordinance No. 630 on May 13, 1993, as amended by
Ordinance No. 642, adopted on July 28, 1993, the Mayor and Council of the City of McCall,
Valley County, Idaho (the "City"), duly created Local Improvement District No. 3 ("L.I.D. No.
3") of the City; and
WHEREAS, by adoption of Ordinance No. 636 on July 3, 1993, as amended by
Ordinance No. 643, adopted on July 28, 1993, the Mayor and Council, pursuant to notice and
hearing as required by law, duly confirmed an assessment roll and thereafter issued and sold
special assessment bonds for L.I.D. No. 3; and
WHEREAS, Section 50-1721A, Idaho Code, provides that whenever any land against
which there has been levied any special assessment by any municipality shall have been sold in
part or subdivided, the council of the municipality shall have the power to order a segregation of
the assessment; and
WHEREAS, by adoption of Ordinance No. 663 on June 30, 1994, the City amended the
assessment roll for L.I.D. No. 3 by segregating a portion of the assessments for Assessment
Parcel A, and by adoption of Ordinance No. 696 on June 28, 1996, the City further amended the
assessment roll for L.I.D. No. 3 by revising the legal descriptions of the property included in
Assessment Parcels A and E, by describing and providing assessments for Spring Mountain
Ranch Subdivision No. 2, and by revising the amounts of assessments for Assessment Parcels A
through M, inclusive; and

WHEREAS, by adoption of Ordinance No. 716 on October 9, 1997, the City further
amended the assessment roll for L.I.D. No. 3 by segregating the assessments for Spring Mountain
Ranch Subdivision No. 3, by removing the assessments from certain property dedicated to the
City for public use, and by reallocating assessments to the remaining Assessment Parcels; and by
adoption of Ordinance No. 719 on December 8, 1997, the City further amended the assessment
roll for L.I.D. No. 3 by segregating the assessments for Block 5 of Spring Mountain Ranch
Subdivision No. 1; and by adoption of Ordinance No. 736 on December 30, 1999, the City
further amended the assessment roll for L.I.D. No. 3 by segregating the assessments for
individual lots within Assessment Parcel J, Blocks 16 and 17 within Spring Mountain Ranch No.
4; and by adoption of Ordinance No. 790 on January 22, 2004, the City further amended the
assessment roll for L.I.D. No. 3 by segregating the assessments for individual lots within portions
of Assessment Parcels D, G, H, and I within Aspen Ridge Subdivision No. 1, all as provided by
Section 50-1721A, Idaho Code; and
WHEREAS, by adoption of Ordinance No. 799 on October 28, 2004, the City further
amended the assessment roll for L.I.D. No. 3 by segregating the assessments for Assessment
Parcels A, B, C, D and H within Aspen Ridge Subdivision No. 2, all as provided by Section 50-
1721A, Idaho Code; and
WHEREAS, the owner of Assessment Parcels G and I, within L.I.D. No. 3 has requested
that the assessment for the remaining unsegregated portions of Parcels G and I, be segregated to
the individual lots within Assessment Parcels G and I in the Aspen Ridge Subdivision No. 3; and
WHEREAS and the City Council has determined that it is in the best interests of the City
to grant such application and to segregate and describe the assessments in accordance with the
application, all as provided by Section 50-1721A, Idaho Code and this Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE
CITY OF McCALL, Valley County, Idaho, as follows:
Section 1: The Council hereby finds and determines:
A. Local Improvement District No. 3 ("L.I.D. No. 3") was duly created by Ordinance
No. 630, adopted on May 13, 1993, as amended by Ordinance No. 642, adopted on July 28,
1993.
B. The assessment roll (the "Assessment Roll") for L.I.D. No. 3 was duly confirmed
by Ordinance No. 636, adopted on July 8, 1993, as amended by Ordinance No. 643, adopted on
July 28, 1993.
C. The Council, pursuant to Ordinance No. 663, adopted on June 30, 1994,
Ordinance No. 696, adopted on June 28, 1996, Ordinance No. 716, adopted on October 9, 1997,
Ordinance No. 719, adopted on December 8, 1997, Ordinance No. 736, adopted on December 30,
1999, and Ordinance No. 790, adopted on January 22, 2004, and Ordinance No. 799 adopted on
October 28, 2004, further segregated certain assessments for L.I.D. No. 3 in the manner provided
by Section 50-1721A, Idaho Code.

D. The owner of Assessment Parcels G and I, within L.I.D. No. 3, has made
application to the City for the segregation of the assessments within Aspen Ridge Subdivision
No. 3 to the individual lots within said Parcels.
E. It is in the best interests of the City and of the property subject to assessment
within L.I.D. No. 3 that the application for segregation of assessments be granted upon the
conditions imposed herein.
F. It is further in the best interests of the City and of the property subject to
assessment within L.I.D. No. 3 that the segregated Assessment Parcels G and I, in Aspen Ridge
Subdivision No. 3, within L.I.D. No. 3 be designated "Aspen Ridge Subdivision No. 3," and
shall be as set forth in Exhibit "A" annexed hereto and by reference made a part of this
Ordinance.
G. The rights and interests of the owners and holders of the special assessment bonds
issued, and the security of the lien for the assessments, for L.I.D. No. 3 will not be adversely
affected by the segregation or designation of such assessments as directed by this Ordinance.
Section 2: The owner of Assessment Parcels G and I, in Aspen Ridge Subdivision
No. 3 within L.I.D. No. 3 shall pay the City the reasonable engineering and clerical costs incident
to this segregation.
Section 3: A copy of the original confirmed Assessment Roll for L.I.D. No. 3,
including the legal description of the properties included within and subject to assessment for
L.I.D. No. 3, as confirmed by Ordinance No. 636, adopted on July 8, 1993, as amended by
Ordinance No. 643, adopted on July 28, 1993, is annexed hereto as Exhibit "B" and by reference
made a part of this Ordinance.
Section 4: The Assessment Roll for L.I.D. No. 3, as further amended by the
segregation of assessments as provided in Ordinance No. 663, adopted on June 30, 1994,
Ordinance No. 696, adopted on June 28, 1996, Ordinance No. 716, adopted on October 9, 1997,
Ordinance No. 719 on December 8, 1997, Ordinance No. 736 adopted on December 30, 1999, by
Ordinance 790, adopted on January 22, 2004, and Ordinance No. 799 adopted on October 28,
2004, is hereby further amended by the following segregation of assessments: the assessment for
Assessment Parcels G and I, within Aspen Ridge Subdivision No. 3, according to the recorded
plat thereof, is hereby segregated to lot numbers 1 through 85, inclusive, of said Parcels G and I,
in the amounts set forth in Exhibit "C" which is annexed hereto and by reference made a part of
this Ordinance.
Section 5: The City Clerk is hereby directed to make the segregation provided by
Section 4 of this Ordinance in the confirmed Assessment Roll for L.I.D. No. 3, as amended.

Section 6:
6.1 The Assessment Roll for L.I.D. No. 3, including all amendments and segregation
of assessments provided by Ordinance No. 663, adopted on June 30, 1994,
. Ordinance No. 696, adopted on June 28, 1996, Ordinance No. 716, adopted on
October 9, 1997, Ordinance No. 719, adopted on December 8, 1997, Ordinance
No. 736, adopted on December 30, 1999, Ordinance 790, adopted on January 22,
2004, Ordinance No. 799, adopted on October 28, 2004, and this Ordinance No.
83 . adopted on January 11, 2007, shall be as set forth in Exhibit "D" which
is annexed hereto and by reference made a part of this Ordinance.
6.2 The assessments segregated by this Ordinance, which are set forth in Exhibit "C,"
shall be paid off in full on or before the date each individual segregated lot or lots
described in Exhibit "C" is sold or otherwise transferred to different owner.
Section 7: All actions hereto taken by the City with respect to the confirmation of the
Assessment Roll for L.I.D. No. 3 by the adoption of Ordinance No. 636, adopted on July 8, 1993,
as amended by Ordinance No. 643, adopted on July 28, 1993, and the segregation of assessments
as provided by Ordinance No. 663, adopted on June 30, 1994, Ordinance No. 696, adopted on
June 28, 1996, Ordinance No. 716, adopted on October 9, 1997, Ordinance No. 719, adopted on
December 8, 1997, Ordinance No. 736, adopted on December 30, 1999, Ordinance 790, adopted
on January 22, 2004, and Ordinance No. 799 adopted on October 28, 2004, are hereby ratified
and confirmed in all respects.
Section 8: A certified copy of this Ordinance shall be filed with the Valley County
Recorder in accordance with Section 50-1721A, Idaho Code.
Section 9: This Ordinance, or a summary thereof in compliance with Section 50-
901A, Idaho Code, substantially in the form annexed hereto as Exhibit "E," shall be published
once in the official newspaper of the City and shall take effect and be in force from and after its
passage, approval, and publication.

Ordinance No. e3 a, adopted on January 11, 2007, takes the assessment for L.I.D. No.
3 covering a portion of the large Parcels known as Parcels G and I within the L.I.D., and divides
the remaining assessments for these large parcels into the individual lots for Aspen Ridge
Subdivision No. 3, which lots are now located within those portions of the larger Parcels G and I.
This Ordinance confirms the Assessment Roll of L.I.D. No. 3, directs the City. Clerk to make the
segregation of the assessment upon the individual lots, ratifies and confirms all actions taken by
the City with respect to L.I.D. No. 3, directs that a certified copy of the Ordinance be filed with
the Valley County Recorder, and provides for publication of this Summary.
The full text of Ordinance No. e3 is available at City Hall, and will be provided to
any citizen upon personal request during normal office hours.
