Member Ann Thies introduced the following resolution and moved its
adoption:
CITY OF MEDINA
RESOLUTION NO. 93-86
RESOLUTION GRANTING AN AMENDED CONDITIONAL
USE PERMIT TO ADAM'S PEST CONTROL, INC.
WHEREAS, Adam's Pest Control, Inc. ( "Applicant") received a conditional use
permit on June 26, 1984 pursuant to Resolution No. 84-48 to operate a business on
the property located at 872 T.H. 55; and
WHEREAS, the Applicant has proposed an amendment to the conditional use
permit to allow an addition to an existing storage building; and
WHEREAS, the planning commission reviewed the proposed amendment on
October 12, 1993 and concluded the amended use would not interfere with the normal
and orderly development of property adjacent to the Applicant; and
WHEREAS, the city council reviewed the matter at its meeting on November 2,
1993 and reached a similar conclusion.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that an amended conditional use permit be granted to the
Applicant for the stated purpose, subject to the following terms and conditions:
1. The expanded storage building shall not exceed 1,350 square feet;
2. A fence shall be constructed to completely enclose the storage building
and the small accessory building to the rear;
3. Fire department data sheets must be maintained;
4. There must be no outside storage on the property;
5. Any additional exterior lighting shall be designed and installed so that
the globe is recessed and enclosed on all sides except the bottom, and
no light is cast directly on any other property;
6. The Applicant shall pay to the city a fee in the amount determined by
the staff to represent the actual cost to the city of reviewing this
amended conditional use permit application; and

7. Resolution No . 84-48 granting the original conditional use permit is
hereby rescinded.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the
City of Medina, Minnesota that a side yard setback variance be granted to reduce the
required side yard setback from 30 feet to 24.06 feet. The variance is justified by
the hardship created by the location of the present building and driveway.

The motion for the adoption of the foregoing resolution was duly seconded by member
Mayor Anne Theis
and upon vote being taken thereon, the following voted in favor thereof:
Council Members John Ferris, Thies, Philip Zietlow and Mayor Theis
and the following voted against same:
Absent: Council Member James Johnson.
None.
Whereupon said resolution was declared duly passed and adopted.
