CITY OF MEDINA
RESOLUTION NO. 93-87
RESOLUTION GRANTING A HEIGHT VARIANCE TO
RICHARD BURKE FOR 3962 TOMAHAWK TRAIL
WHEREAS, Richard Burke ("Applicant") has requested permission to
construct a single family residence located on the property at 3962 Tomahawk Trail;
and
WHEREAS, the proposed structure includes a tower which is 72 feet in height;
and
WHEREAS, the city's zoning ordinance prohibits single family structures from
exceeding 30 feet in height; and
WHEREAS, this matter has been reviewed by the planning commission on
October 12, 1993 and the city council on November 2, 1993.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that a height variance be granted to the Applicant for a single
family structure at the above location, subject to the following terms and conditions:
1. The height of the tower may be increased from 30 feet to 72 feet;
2. The property may never be subdivided such that the lot on which this
structure is located is less than 25 acres;
3. The entire house must be sprinkled to NFPA 13 standards;
4. There shall be no habitable space in the tower;
5. There shall be a suction line installed from the swimming pool for fire
safety;
6. There shall be a pump and line installed from the lake for fire safety;
7. There shall be two water wells served by separate electrical services;

8. The plans for the tower must be reviewed by the Loretto fire
department, city fire marshall and building inspector before
construction begins on the tower;
9. The Applicant shall pay to the city a fee in the amount determined by
the staff to represent the actual cost to the city of reviewing this
variance application;
10. The Applicant shall execute such restrictions or covenants for
recording against the property as may be required by the city attorney
in order to implement the city's intent in granting the variance; and
11. Any violation of the terms and conditions of this resolution or any city
ordinance related thereto shall be grounds for revocation of the
variance.
The variance is justified by the fact that the structure will comply with all reasonable
fire safety requirements .

The motion for the adoption of the foregoing resolution was duly seconded by member
Mayor Anne Theis
and upon vote being taken thereon, the following voted in favor thereof:
Council Members John Ferris, Thies, Philip Zietlow and Mayor Theis
and the following voted against same: None.
Absent: Council Member James Johnson.
Whereupon said resolution was declared duly passed and adopted.
