March 29, 1983
The Council of Bal Harbour Village met Tuesday, March 29, 1983 at 9:30 A.M.
in the Village Hall.
Present: Messrs. Beatty, Printup, Sherman, Taplin and Miss Gray
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer,
Village Clerk; and Alan S. Gold, Village Attorney.
On motion of Mr. Beatty, seconded by Miss Gray and voted the minutes of
February 22, 1983 were approved as submitted.
Mr. Maley reported that bids had been received on March 24, 1983 for the
new bus -bay and sidewalk fronting Bal Harbour Shops. The bids were as follows:
Florida Engineering Construction, $82,000; Marks Brothers Company, $63,950;
Target Construction Company, $64,750 and Williams Paving Company, $59,000. It
is the recommendation of our Village Engineers and himself that the bid of
Williams Paving Company be accepted as they have done work for the Village before
and are also low bidder. The contract calls for substantial completion in sixty
days and a seventy-five day construction time limit. It was moved by Mr. Beatty,
seconded by Mr. Taplin and voted that the contract be awarded to Williams Paving
Company.
Mr. Gold advised that after the item on newsracks was discussed at the last
meeting he and Mr. Maley met with representatives of Ganat Publishing Company.
He said that Bal Harbour Village cannot ban newsracks or make the distributors
apply for a permit, however, we do have the authority to regulate the number and
placement. Mr. Gold presented copies of a proposed ordinance and explained that
he and Mr. Maley will continue to talk to the publishing companies that have
placed racks in the village. Mr. Gold read proposed Ordinance No. 250 and
explained the provisions. Discussion followed by the council and those in the
audience regarding the use of racks for advertising purposes, excessive number
of racks and the type of rack sales permitted. It was moved by Mr. Taplin,
seconded by Miss Gray and voted that Ordinance No. 250 be passed on first reading
by title only.
Mr. Maley introduced Mr. Don Ditzenberger and Fraseur Knight, village engineer
and architect for the proposed Public Works facility. Mr. Ditzenberger explained
the purposes for which the building would be used and said their estimated cost
is $464,000 and an additonal cost of $34,00 for the stand-by generator. Mr. Taplin
suggested that the money could be used to a better advantage for Collins Avenue
beautification. Mr. Maley explained that to defray most of the cost that $100,000
had been budgeted each year for the past two fiscal years and is in the budget
passed for this fiscal year and that money is in the Tourism Department for
future improvements. Mr. Whitman of the Bal Harbour Shops said he opposed the
expenditure and suggested that the water tank will no longer be needed when
the Dade County Water and Sewer Authority runs the 24' line from the mainland
in five years. 'It was moved by Mr. Sherman, seconded by Mr. Beatty and voted
that the Public Works facility be put out for bids. The motion passed with
Miss Gray and Messrs. Beatty, Printup and Sherman voting, "yes"; Mr Taplin, "no".
Mr. Maley said that he had an inquiry from Mr. Reibman of UltraCom Cable
Television who inquired if a dish antenna company serving the high rises needed a
franchise or license. Mr. Gold advised that no license would be needer unless
they are using the public right of way, unless council wishies to put it in the
ordinance.

Mr. Maley said he would advise the cable company that the village cannot
keep the companies from installing the dish antennas.
Mr. Ralph Gimel of the Bal Harbour Resort Authority Association said
they met last week with the Greater Miami Hotel and Motel Association
who are promoting a Super Tourism Agency to be financed with funds from
the tourist tax from Dade Co., Miami Beach, Surfside and Bal Harbour.
Under their plan the beach communities would contribute over 50% of the
funds and have only minor representation. It was agreed that due to the
state of the tourism industry that we should agree in principal to area -
wide advertising, however, we should find out more about their plans and
what controls will be placed on the use of the money. Mr. Gimel said
that representatives from Bal Harbour, Surfside and Miami Beach were going
to meet tomorrow to discuss the matter.
The Department of Tourism presented twelve Matching Funds contracts
for approval for the 1982-83 fiscal year. The council discussed the
matching fund concept and on motion of Mr. Sherman, seconded by Miss Gray
and voted the contracts were approved.
Mr. Maley said he had a request from the City of Coral Gables asking
Bal Harbour to contribute to a preliminary Double Taxation study for Dade
County cities. He advised that the study would be undertaken by Planned
Management Corporation. It was moved by Mr. Beatty, seconded by Mr. Taplin
and voted that we contribute $100.00 toward the study.
Mr. Maley said that our groins are in bad repair and would like to
have Mr. von Oesen's opinion on what should be done. The council in-
structed the Manager to take care of this.
Mr. Maley informed the council that he had arranged to have the firms
wishing to do the Collins Avenue study to be present after the Induction
Meeting on April 18, 1983.
Mr. Maley said he would have the sidewalks steam cleaned to remove
the unsightly paint indicating underground utilities removed.
On motion of Miss Gray, seconded by Mr. Beatty and voted the meet-
ing was adjourned at 12:30 P.M.
