RESOLUTION NO. 13-8665
A RESOLUTION OF THE CITY OF OPA-LOCKA, FLORIDA
INDICATING THE OFFICIAL INTENT OF THE CITY TO ISSUE
OBLIGATIONS,TO FINANCE,TOGETHER WITH OTHER LEGALLY
AVAILABLE FUNDS OF THE CITY, THE COST OF ACQUISITION,
IMPROVEMENT AND EQUIPPING OF A BUILDING OR PORTION
THEREOF TO BE USED FOR CITY PURPOSES, INCLUDING FOR
ADMINISTRATIVE OFFICES AND/OR LEASE TO THIRD PARTIES,
AND THE COSTS RELATED OR INCIDENTAL THERETO,FUNDING
NECESSARY RESERVES FOR SUCH OBLIGATIONS,AND PAYING
COSTS OF ISSUANCE OF SUCH OBLIGATIONS AND TO USE A
PORTION OF THE PROCEEDS OF SUCH OBLIGATIONS TO
REIMBURSE EXPENDITURES PAID OR INCURRED PRIOR TO THE
DATE OF ISSUANCE THEREOF: PROVIDING FOR
INCORPORATION OF RECITALS;PROVIDING FOR AN EFFECTIVE
DATE
WHEREAS, the City of Opa-locka, Florida (the "City") intends to issue Obligations (the
"Obligations") to finance, together with other legally available funds of the City, the cost of
acquisition, improvement and equipping of a building or portion thereof to be used for City
purposes, including for administrative offices and/or lease to third parties, and the costs related or
incidental thereto (collectively, the "Project"), funding necessary reserves for the Obligations and
paying costs of issuance of the Obligations; and
WHEREAS, a portion of the costs of the Project may be paid or incurred before the
Obligations are issued in anticipation of the reimbursement of such expenditures from proceeds of
the Obligations; and
WHEREAS, section 1.150-2 of the Federal income tax regulations requires the City to
officially declare its intent to use proceeds of any Obligations,the interest on which is intended to be
exempt from federal income tax for purposes of the Income Tax Code of 1986, as amended (the
"Tax-Exempt Obligations"), to reimburse expenditures paid prior to issuance thereof as a
prerequisite to the proceeds thereof being treated as used for reimbursement purposes.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF OPA-LOCKA,
FLORIDA that:
Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City intends to issue the Obligations in an amount,at a minimum,that is
necessary to finance the costs of the Project,all or a portion of which may be issued as Tax-Exempt
Obligations.Notwithstanding anything to the contrary herein,the City may elect to issue Obligations
to finance all or a portion of the Project on a taxable basis, in addition to, or in lieu of, issuing the
Tax-Exempt Obligations. Nothing herein shall be construed as requiring the City to issue the
Obligations.
Section 3. The maximum principal amount of the Tax-Exempt Obligations expected to
be issued to finance the Project is $12,000,000.
Section 4. This resolution shall take effect immediately upon adoption

Staff Summary:
The City of Opa-locka requested proposals for the Capital Improvement Project (CIP) Master Plan preparation and
awarded the project to EAC Consulting, Inc. The CIP Master Plan includes Wastewater Master Plan, Drinking
Water Master Plan, Stormwater Master Plan and also Roadway Master Plan. The wastewater master plan will be
used for projects identification, funding and to formulate the implementation strategy including the level-of-
service standards as necessary for the City's wastewater system.

Proposed Action:
Staff recommends approval in order to move ahead with the capital improvement program, funding, budget
planning, and implementation strategy.

Plan
Request: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA,
FLORIDA AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
AGREEMENT WITH EAC CONSULTING, INC. IN THE AMOUNT NOT TO
EXCEED FIVE HUNDRED TWELVE THOUSAND EIGHT HUNDRED SIX
DOLLARS AND TWENTY FIVE CENTS ($512,806.25) FOR THE PREPARATION
OF WASTEWATER MASTER PLAN PAYABLE FROM ACCOUNT 32-541340
AND 35-541340. THE CONSULTING FEE WILL BE FUNDED BY FLORIDA
DEPARTMENT OF ENVIRONMENTAL PROTECTION (FDEP) THROUGH
STATE REVOLVING LOAN SYSTEM.
Description: The City of Opa-locka requested proposals for the Capital Improvement Project(CIP) Master

Financial Impact: The consulting fee for the preparation of the wastewater master plan will be funded by
FDEP upon execution of the State Revolving Loan Agreement with FDEP.

8. The EAC team will base projected wastewater flows on population estimates from BEBR or the
City's projections of population. Peaking factors will be based on a review of up to three (3)
years of historical data and/or other industry standards.
9. The City will provide the project team with copies of all Utility Agreements with MD-WASD, and
historical monthly records of the total sewer treated by MD-WASD for a maximum of three (3)
years.
10. The City will make available, an electronic copy of the Traffic Master Plan being conducted by
another consultant for coordination purposes with the Utilities Master Plan. In the event that
this document is not readily available, the City will facilitate meetings and instruct the assigned
consultant to provide the EAC team with relevant information, especially as it relates to future
roadway improvements such as roadway widening, intersection improvements.
11. Identification of previous Pipe Breakages and Leakage within the System
12. The EAC team assumes that the City will provide one set of consolidated comments for each
reviewed document and will provide feedback to EAC within time allocated on the schedule.
13. Meeting venues, refreshments(if required)and snacks(if required)will be provided by the City.
14. The City will facilitate the receipt of data, reports and other technical data prepared by others
that may be relevant to the Scope of Services(e.g the Traffic/Transportation Master Plan).
15. Copies of handouts and fact sheets for Public Involvement Meetings will be provided by the City.
16. Costs and fees associated with Newspaper Advertisements,etc.will be provided by the City.
