Member James Johnson adoption: introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO. 93-94 RESOLUTION GRANTING A VARIANCE TO CLYDE LIBBY FOR LOTS 1 AND 3, LIBBY ADDITION WHEREAS, Clyde Libby (Applicant) has requested a variance to have Lots 1 and 3, Block 1, Libby Addition, Hennepin County, Minnesota declared a buildable site for residential purposes; and WHEREAS, the combined area of Lots 1 and 3, Block 1, Libby Addition is about 2.22 acres and the city's zoning ordinance requires a minimum lot size of 5 acres under existing soil conditions; and WHEREAS, Lot 2, Block 1, Libby Addition was sold separately and the Applicant owns no other property adjacent to Lots 1 and 3, Block 1, Libby Addition which may be added thereto in order to comply with minimum lot size requirements; and WHEREAS, under the Award of Arbitrator dated October 8, 1993 in the matter of Libby v. City of Medina, D.C. File No. AP93-8780, the city of Medina has been ordered to grant a variance to the Applicant to have Lots 1 and 3, Block 1, Libby Addition declared a buildable site. NOW, THEREFORE, IN SATISFACTION OF SAID AWARD OF ARBITRATOR, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicant be granted a variance from the minimum lot area requirement of the city ordinances to be able to construct a house on Lots 1 and 3, Block 1, Libby Addition, subject to the following conditions: 1. Lots 1 and 3, Block 1, Libby Addition must be combined and used as a single development site; RHB62116 GA115-19 2. The Applicant must grant an easement for an alternate septic site for Lot 2, Block 1, Libby Addition in the area and of the size determined by the city engineer; 3. The Applicant must pay to the city an administrative fee equal to the city's cost to review this application; and 4. Any violation of the terms and conditions of this variance or of any related city ordinance or regulation will be grounds for revocation of the variance. Dated: December 7 ATTEST: , 1993. Ann C.
