CITY OF MEDINA
RESOLUTION NO. 93-99
RESOLUTION GRANTING SETBACK VARIANCES TO
DENNIS KLAGES AND WANDA KLAGES FOR PROPERTY
AT 4642 BALSAM STREET
WHEREAS, Dennis Klages and Wanda Klages (Applicants) have proposed to
develop the property located at 4642 Balsam Street with a single family detached
dwelling; and
WHEREAS, the proposed house would necessitate reducing the required front
yard setback from Lakeshore Avenue from 30 feet to 25.5 feet; reducing the required
front yard setback from Balsam Street from 30 feet to 26 feet; and reducing the
required rear yard setback from 30 feet to 14.7 feet; and
WHEREAS, the city's zoning ordinance and state statute prohibit granting
variances from the zoning ordinance except in circumstances in which there is a
demonstrated hardship related to the property and in which the variances will be
consistent with neighborhood standards; and
WHEREAS, the planning commission reviewed this matter on November 9, 1993
and the city council reviewed it on December 7, 1993.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that the specified setback variances be granted to the Applicants
for the subject property, subject to the following conditions :
1. The existing sheds must be removed within 60 days of the completion of
the new house;
2. The existing cabin must be removed from the property;
3. The Applicants must pay to the city a fee in the amount determined by
the city staff to represent the actual cost to the city for reviewing this
variance application; and

4. Any violation of the terms and conditions of this resolution or any city
ordinance related thereto shall be grounds for revocation of the
variance.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the hardships justifying
the setback variance are the small size of the property and the fact that it is a corner
lot and thus subject to two front yard setbacks .

The motion for the adoption of the foregoing resolution was duly seconded by member
Philip Zietlow
and upon vote being taken thereon, the following voted in favor thereof :
Council Members Ferris, James Johnson, Ann Thies, Zietlow and Mayor Anne Theis
and the following voted against same: None.
Absent: None.
Whereupon said resolution was declared duly passed and adopted.
