AN ORDINANCE, declaring the necessity for the acquisition of easements and
temporary construction easements in certain real property within The Metropolitan St. Louis Sewer
District for the purpose of construction of sewers and related appurtenances in the project known
as CSO - Brentwood and Red Bud Ave CSO Interceptor (I-118)/Outfall (L-111) Elimination and
Sewer Separation (12139) in the Cities of Clayton and Richmond Heights, Missouri to serve the
needs of residents of the area, and authorizing staff to proceed with further condemnation efforts
related to the project, including but not limited to the purchase and/or the filing of all necessary
court pleadings or documents to commence and prosecute formal legal proceedings for the
acquisition of said easements and temporary construction easements.
WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area
of Clayton and Richmond Heights, Missouri within the Deer Creek Watershed wherein numerous
people live and work;
WHEREAS, sewage gathered from such area will have no adequate means of
disposition, and will constitute a menace to public health and welfare of the general public and the
residents of The Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer
District to protect the public health and welfare by construction, reconstruction, maintenance or
repair of sewers and related appurtenances on, over and across said area in order to relieve and
alleviate these conditions.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve dangerous conditions,
it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise
easements and temporary construction easements in real property for the construction of sewers
and related appurtenances in the project known as CSO - Brentwood and Red Bud Ave CSO
Interceptor (I-118)/Outfall (L-111) Elimination and Sewer Separation (12139) hereinafter set
forth, said easements being more particularly described below:
PARCEL #8 A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT across Lot 55 of Clayton Road Terrace as recorded in Plat Book 18, Page 18 of the St. Louis County, Missouri
Recorder’s Office, being more particularly described as follows:
BEGINNING at the westernmost corner of Lot 55 of Clayton Road Terrace as recorded in Plat Book 18, Page 18 of the St. Louis County, Missouri Recorder’s Office; said point also being on the Southeast right-of-way line of East Linden Avenue, 50 feet wide; THENCE along said right-
of-way line 11.15 feet on a curve to the right having a radius of 193.08 feet and a chord bearing of
North 25 degrees 58 minutes 31 seconds East to the northwesterly prolongation of a line 1.00 foot southwest of and parallel with the southwest face of a brick building; THENCE leaving said right-of-way line and continuing along said northwesterly prolongation, parallel line, and southeasterly prolongation thereof, South 56 degrees 51 minutes 57 seconds East 71.40 feet the southwesterly
prolongation of a line 1.00 foot southeast of and parallel with the southeast face of said building;
THENCE continuing along said southwesterly prolongation and parallel line North 33 degrees 06 minutes 20 seconds East 26.00 feet to a point; THENCE continuing along a line parallel with the Southwest line of the aforementioned Lot 55 South 57 degrees 04 minutes 37 seconds East 18.92 feet to a point; THENCE leaving said parallel line and continuing along a line perpendicular to
said Southwest line South 32 degrees 55 minutes 23 seconds West 17.42 feet to a line 1.00 foot
northeast of and parallel with the northeast edge of a carport; THENCE leaving said perpendicular line and continuing along said parallel line and the northwesterly prolongation thereof North 57 degrees 19 minutes 48 seconds West 6.93 feet to the northeasterly prolongation of a line 1.00 feet northwest of parallel with the northwest edge of a carport; THENCE leaving said northwesterly
prolongation and continuing South 32 degrees 30 minutes 17 seconds West 19.36 feet to the
Southwest line of the aforementioned Lot 55; THENCE continuing along said Southwest line North 57 degrees 04 minutes 37 seconds West 82.27 feet to the POINT OF BEGINNING. TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of
the above-described project.
PARCEL #12 A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT across parts of Lots 58
and 59 of Clayton Road Terrace as recorded in Plat Book 18, Page 18 of the St. Louis County,
Missouri Recorder’s Office, being more particularly described as follows:
BEGINNING at the northernmost corner of the tract of land described in Quit Claim Deed to Stephen Wolff as recorded in Deed Book 20190, Page 1745 of the St. Louis County, Missouri
Recorder’s Office; said point also being on the Southeast right-of-way line of East Linden Avenue,
50 feet wide; THENCE along the Northeast line of said tract South 63 degrees 56 minutes 23 seconds East 86.87 feet to a point; THENCE leaving said Northeast line and continuing South 26 degrees 02 minutes 10 seconds West 25.49 feet to a point; THENCE North 61 degrees 36 minutes 25 seconds West 19.95 feet to a line 1.00 foot southeast of and parallel with the southeast face of
a brick building; THENCE continuing along said parallel line and the northeasterly prolongation

the above-described project.
PARCEL #13 A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT across a part of Lot 59
of Clayton Road Terrace as recorded in Plat Book 18, Page 18 of the St. Louis County, Missouri
Recorder’s Office, being more particularly described as follows: BEGINNING at the westernmost corner of the tract of land described in Quit Claim Deed to Alvin Earl Wendt and Sandra A. Krumrey-Wendt, Trustees, as recorded in Deed Book 22037, Page 379
of the St. Louis County, Missouri Recorder’s Office; said point being on the Southeast right-of-
way line of East Linden Avenue, 50 feet wide; THENCE along said right-of-way line 13.65 feet on a curve to the left having a radius of 1219.70 feet and a chord bearing of North 27 degrees 26 minutes 09 seconds East to a point; THENCE leaving said right-of-way line and continuing along a line parallel with the Southwest line of the aforementioned tract South 63 degrees 56 minutes 23
seconds East 25.02 feet to a line perpendicular to said Southwest line and running through a point

Southeast right-of-way line of East Linden Avenue, 50 feet wide; THENCE along the Northeast

BEGINNING at the northeast corner of the tract of land described in General Warranty Deed to David Luong as recorded in Deed Book 14585, Page 2150 of the St. Louis County, Missouri Recorder’s Office, said point being on the West right-of-way line of Terrace Drive, 40 feet wide;
THENCE along said right-of-way 10.23 feet on curve to the right having a radius of 257.50 feet

BEGINNING at the northeast corner of Lot 67 of Clayton Road Terrace as recorded in Plat Book 18, Page 18 of the St. Louis County, Missouri Recorder’s Office, said point being on the Northwest right-of-way line of Terrace Drive, 40 feet wide; THENCE along said right-of-way 10.16 feet on
a curve to the right having a radius of 257.50 feet and a chord bearing of South 16 degrees 10

Book 18, Page 18 of the St. Louis County, Missouri Recorder’s Office, said point also being on
the Northeast right-of-way line of Terrace Drive, 40 feet wide; THENCE along said right-of-way line 11.08 feet on a curve to the left having a radius of 297.50 feet and a chord bearing of North 35 degrees 40 minutes 57 seconds West to the Northwest line of a 10.00 foot wide easement conveyed to the Metropolitan St. Louis Sewer District by instrument recorded in Deed Book

Page 18 of the St. Louis County, Missouri Recorder’s Office.
TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of the above-described sewer construction.

A VARIABLE WIDTH SEWER EASEMENT across Lot 28 of Lake Forest as recorded in Plat Book 28, Page 36 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows:
BEGINNING at the northeast corner Lot 28 of Lake Forest as recorded in Plat Book 28, Page 36 of the St. Louis County, Missouri Recorder’s Office, said point also being on the Northwest right-
of-way line of Lake Forest Drive, 50 feet wide; THENCE along said right-of-way line 26.64 feet on a curve to the left having a radius of 325.00 feet and a chord bearing of South 16 degrees 37
minutes 01 seconds West to a point; THENCE leaving said right-of-way line and continuing North

easement recorded in Plat Book 28, Page 36 of said Recorder's Office. TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of the above-described sewer construction.
PARCEL #30 A VARIABLE WIDTH SEWER EASEMENT across Lot 9 of Lake Forest as recorded in Plat Book 28, Page 36 of the St. Louis County, Missouri Recorder’s Office, being more particularly

COMMENCING at the northernmost corner Lot 9 of Lake Forest as recorded in Plat Book 28, Page 36 of the St. Louis County, Missouri Recorder’s Office, THENCE along the Northeast line of said Lot 9 South 51 degrees 23 minutes 16 seconds East 12.78 feet to the East line of a 10.00
foot wide easement depicted on said plat of Lake Forest, said point also being on the East line of

Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is
hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue
with the condemnation process by preparing and/or filing all necessary court pleadings and
documents to institute and prosecute legal actions in condemnation to acquire all easements for
the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St.
Louis Sewer District and the laws of the State of Missouri for the appropriation of private property
rights as hereinabove set out.
