Home My Public Portal About13-8679 OLCDC Settlement for Code Enforcement Fines Sponsored by: City Manager RESOLUTION NO. 13-8679 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA TO ACCEPT $5000 FROM OPA-LOCKA COMMUNITY DEVELOPMENT CORP (OLCDC) IN SETTLEMENT FOR CODE ENFORCEMENT FINES FOR PROPERTIES LOCATED AT 15050 LINCOLN (ALSO KNOWN AS 15050 DUVAL), 2060 LINCOLN, AND 2070 LINCOLN; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Opa-locka Community Development Corp ("OLCDC") is attempting to secure the necessary funding to rehabilitate properties in concert with the Magnolia North Rehabilitation; and WHEREAS, there are questionable code enforcement liens levied against the properties located at 15050 Lincoln (also known as 15050 Duval), 2060 Lincoln, and 2070 Lincoln, now owned by OLCDC; and WHEREAS, the liens are of uncertain validity, in that some have been satisfied, some were previously waived by the City, and some have questions about proper notice; and WHEREAS, the OLCDC proposes and offers to the City the sum of$5000 to settle the code enforcement liens for properties located at 15050 Lincoln (also known as 15050 Duval), 2060 Lincoln, and 2070 Lincoln. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: Section 1. The recitals to the preamble are hereby incorporated by reference. Resolution No. 13-8679 Section 2. The City Commission of the City of Opa-locka, Florida, hereby accepts the OLCDC proposal for settlement in the amount of $5000, for the liens against properties located at 15050 Lincoln(also known as 15050 Duval), 2060 Lincoln, and 2070 Lincoln. Staff researched the request and noted that there are 2 types of liens outstanding on these properties ie: Water/ Sewer liens of $20,663.27 and Code enforcement liens of $42,158.06. Statutorily the water/sewer liens of 20,663.27 cannot be waived;and will be required to be paid.The commission has the option to waive code enforcement fines and citations at their discretion. Financial Impact: This action will reduce the account receivables balance but will enhance the tax base of the city.
