HomeMy Public PortalAbout16340 Maline Creek Bank Stabilization (St. Louis Place to Florissant Road) (11292)O R D I N A N C E NO. 16340 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary construction easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as Maline Creek Bank Stabilization (St. Louis Place to Florissant Road) (11292) in Ferguson, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of Ferguson, Missouri within the Maline Creek Watershed wherein numerous people live and work; WHEREAS, stormwater gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as Maline Creek Bank Stabilization (St. Louis Place to Florissant Road) (11292) hereinafter set forth, said easements being more particularly described below: PARCEL #2 A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT across a tract of land being Lots 1 & 3 and Part of Lot 2 in Block 5 of “Ferguson Heights”, as recorded in Plat Book 7, Page 91 of the St. Louis County Recorder’s Office, St. Louis County, Missouri, and being more particularly described as follows: BEGINNING at a point being the Northeast corner Lot 1 in Block 5 of “Ferguson Heights”, as recorded in Plat Book 7, Page 91 of the St. Louis County Recorder’s Office, said point also being in the South line of Paul (50 feet wide) Avenue; THENCE along the East line of the aforementioned Lot 1 South 12 degrees, 08 minutes, 27 seconds East a distance of 103.83 feet to a point; THENCE along the South line of the aforementioned Lot 1 South 80 degrees, 34 minutes, 53 seconds West a distance of 15.42 feet to a point; THENCE North 21 degrees, 34 minutes 59 seconds West a distance of 102.40 feet to a point in the North line of aforementioned Lot 1, said point also being in the South line of Paul (50 feet wide) Avenue; THENCE along said the South line North 74 degrees, 09 minutes, 33 seconds East a distance of 32.27 feet to the POINT OF BEGINNING of the herein described VARIBALE WIDTH TEMPORARY CONSTRUCTION EASEMENT. TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above-described sewer construction. PARCEL #3 A VARIABLE WIDTH SEWER EASEMENT across a tract of land being Part of Lot 11 of “Universal Park”, as recorded in Plat Book 40, Page 34 of the St. Louis County Recorder’s Office, St. Louis County, Missouri, and being more particularly described as follows: BEGINNING at a point being the Southwest corner Lot 11 of “Universal Park”, as recorded in Plat Book 40, Page 34 of the St. Louis County Recorder’s Office, THENCE along the West line of the aforementioned Lot 11 North12 degrees, 08 minutes, 27 seconds West a distance of 7.38 feet to a point; THENCE North 70 degrees, 55 minutes, 08 seconds East a distance of 32.86 feet to a point; THENCE North 67 degrees, 00 minutes 10 seconds East a distance of 62.31 feet to a point; THENCE South 30 degrees, 18 minute, 17 seconds East a distance of 5.04 feet to a point; THENCE South 67 degrees, 00 minutes, 10 seconds West a distance of 97.13 feet to the POINT OF BEGINNING of the herein described VARIBALE WIDTH SEWER EASEMENT. Excepting therefrom those portions covered by the existing easements recorded in Deed Book 2787, Page 119 and Deed Book 4105, Page 158 of said Recorder’s Office. Also, A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT across a tract of land being Part of Lot 11 of “Universal Park”, as recorded in Plat Book 40, Page 34 of the St. Louis County Recorder’s Office, St. Louis County, Missouri for use during the construction of any sewer in the above-described VARIABLE WIDTH SEWER EASEMENT; said TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows: BEGINNING at the Northwest corner of Lot 11 of “Universal Park”, as recorded in Plat Book 40, Page 34 of the St. Louis County Recorder’s Office; THENCE along the North line of said Lot 11 North 63 degrees, 21 minutes, 33 seconds East a distance of 10.93 feet to a point; THENCE South 24 degrees, 40 minutes, 04 seconds East a distance of 67.90 feet to a point; THENCE South 70 degrees, 55 minutes, 08 seconds West a distance of 25.49 feet to a point in the West line of said Lot 11; THENCE along said West line North 12 degrees, 08 minutes, 27 seconds West a distance of 66.62 feet to the POINT OF BEGINNING of the herein described VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above-described sewer construction. PARCEL #4 A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT across a tract of land being Lot 10 and Part of Lot 11 of “Universal Park”, as recorded in Plat Book 40, Page 34 of the St. Louis County Recorder’s Office, St. Louis County, Missouri, and being more particularly described as follows: COMMENCING at a point being the Southeast corner of said Lot 10 of “Universal Park” as recorded in Plat Book 40, Page 34; THENCE along the East line of said Lot 10 North 30 degrees, 16 minutes, 42 seconds West a distance of 17.41 feet the TRUE POINT OF BEGINNING of the herein described VARIBALE WIDTH TEMPORARY CONSTRUCTION EASEMENT; THENCE South 64 degrees, 51 minutes, 25 seconds West a distance of 60.08 feet to a point; THENCE South 70 degrees, 55 minutes, 08 seconds West a distance of 12.38 feet to a point; THENCE North 30 degrees, 18 minutes, 17 seconds West a distance of 8.73 feet to a point; THENCE North 64 degrees, 51 minutes, 25 seconds East a distance of 72.26 feet to a point in the East line of said Lot 10; THENCE along said East line of said Lot 10 South 30 degrees, 16 minutes, 42 seconds East a distance of 10.04 feet to the POINT OF BEGINNING of the herein described VARIBALE WIDTH TEMPORARY CONSTRUCTION EASEMENT TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above-described sewer construction. TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above-described sewer construction. Also, a 10-FOOT-WIDE TEMPORARY CONSTRUCTION EASEMENT for use during the construction of any sewer in the above-described VARIABLE WIDTH SEWER EASEMENT; said 10-FOOT-WIDE TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows: COMMENCING at a point being the Southwest corner Lot 7 of “Universal Park”, as recorded in Plat Book 40, Page 34 of the St. Louis County Recorder’s Office, THENCE along the West line of said Lot 7 North 30 degrees, 14 minutes, 16 seconds West a distance of 26.78 feet to the TRUE POINT OF BEGINNING of the centerline of the herein described 10 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT; THENCE North 64 degrees, 51 minutes, 25 seconds East a distance of 50.18 feet to a point in the East line of Said Lot 8, said point also being the POINT OF TERMINUS of the centerline of the herein described 10 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT. Also, a 10-FOOT-WIDE TEMPORARY CONSTRUCTION EASEMENT for use during the construction of any sewer in the above-described VARIABLE WIDTH SEWER EASEMENT; said 10-FOOT-WIDE TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows: COMMENCING at a point being the Southwest corner Lot 6 of “Universal Park”, as recorded in Plat Book 40, Page 34 of the St. Louis County Recorder’s Office, THENCE along the West line of said Lot 6 North 30 degrees, 13 minutes, 27 seconds West a distance of 28.68 feet to the TRUE POINT OF BEGINNING of the centerline of the herein described 10 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT; THENCE North 64 degrees, 51 minutes, 25 seconds East a distance of 49.94 feet to a point in the East line of Said Lot 6, said point also being the POINT OF TERMINUS of the centerline of the herein described 10 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out.
