HomeMy Public PortalAbout76-086 (10-05-76)r • ,, • • , , RESOLUTION N0. 76-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, AMENDING SECTION 23 OF THE PERSONNEL RULES AND REGULATIONS PERTAIN- ING TO HOURLY EMPLOYEES. WHEREAS, the City Council of the City of Lynwood, California, received and reviewed a recommendation from the Personnel Board of said City relating to amendment of Section 23 of the Personnel System Rules and Regulations pertaining to definition of Hourly Employees; and WHEREAS, the existing definition reads as follows: "Section 23. Hourly Employees: Employees paid on hourly basis where necessary because of the nature of the work. Hour~y employees have no civil service status, vacation, sick leave or holiday privileges"; and WHEREAS, the City Council noted that the Personnel Board found the existing definition of Hourly Employees to be inadequate, inasmuch as limiation of hours to be worked by each hourly employee was lacking; and WHEREAS, said recommendation referred to a Memorandum of Understanding negotiated in 1974, which provided that if hourly employees work thirty-five (35) hours a week or more, that vacation time be granted;.and WHEREAS, since the existing definition of Hourly Employees prohibits such employees from taking vacation time, it is incompatible with the intent of said Memorandum of Understanding; and WHEREAS, said incompatibility dilutes the intent of the definition for Hourly Employees and makes it difficult to regulate hourly employment; ~ ~ ~ ~ , , . ~ . NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lynwood, pursuant to the above findings, does hereby amend Section 23 of Rule IB (Definition of Terms) of the Personnel System Rules and Regulations, to read as follows: ' "Section 23. Hourly Employees. Employees paid on hourly basis where necessary because of the nature of the work. No hourly person, temporary help, or seasonal help shall work 35 or more hours in any week, and that no allowance be made for overtime work.
