ORDINANCE NO. 1379
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF LYNWOOD'REVISING CHAPTER 13 OF THE LYNWOOD
MUT~ICIPAL CODE RELATING TO REVOCATION OF STREET
AND SIDEWALK USE PERMITS AND CORRECTING ERRORS
THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA,
DOES OR?~AIP1 AS FOLLOWS:
SECTION 1: ~ The title of Section 13-2 of the Lynwood
Municipal Code is hereby amended to read as follows:
13-2 PLANTING OR REMOVING TREES IN PARKWAYS
SECTION 2: Subsection 13-6 (c ) of the Lynwood
Municipal Code is hereby amended to read as follows:
c. Permit Required. A person shall not place upon
or use any newsstand or newsrack upon any street, except in
conformity with all of the provisions of this section and
until a permit~is obtained from the City Manager and a
permit fee in an amount established by resolution of
the City Council is paid..
SECTION 3: Subsection 13-6 (1 ) bf the Lynwood
Muni_ci~al Code is hereby amended to read:
"1. Notice of Denial. If the City Manager denies a
permit, he shall so inform t'r.e applicant in writing and also

Section 13-I2." - _ _. __ .,_
SECTION 4: Subsection 13-6(m) of the Lynwood
Punicipal Code is hereby repealed. The subsequently lettered
subsections shall be adjusted accordingly.
7 SECTION 5: Subsection 13-6 (u ) of the Lynwood
Municipal Code is hereby amended to read as follows:
. "u. Appeal of Revocation. The City Manager shall
send the permittee written notification. of revocation
of the permit. The notice shall contain the reason for
revocation, and shall inform the permittee that he may
file an appeal pursuant to Section 13-12.."
SECTION 6: Subsection 13-7 of the Lynwood Municipal
Coda is riereby amended by adding thereto a new subsection (d), to
(d) Grounds for Revocation ~ '
1. I~7 the event that the holder of any permit
issued. pursuant to this section is convicted in any •
court of co?,lpetent jurisdiction for violating any- of
the previsions of this section, the permit shall be
revo:~ed by the City Clerk upon the filing of the
-record of such c~:.rwiction with the City Clerk, and no
permit shall be thereafter be issued to that person or .
iirm until six (E) months Yiave elapsed from the date of
~ti-~e revocation. .

Code is hereby repealed.

SECTION 9: A new section 13-12 is added to the
Lynwood Municipal Code,. to read as follows:
' "13-12 .APPEAL OF DErd:IAL OR REVOCATION .
•, ,. a. Appeal. When any permit pursuant to the
provisions of the Chapter is denied or revoked such
denial or rEVOCation may be appealed to the
City Council in accordance with this section.
b. 'Pirne Limit. An appeal shall be-filed
within ten (1G) days of the date written notice is -
dep~sited in the mail. If an appeal is not filed
within this time, the denial or revocation shall
. be final . ~
c. F'ilin The appeal shall be in writing

d. Hearing. Upon 'receipt of an appeal, the
City Manager shall calendar a hearing before t?he City
Council at which the permittee may present hiss
reasons for continuing the permit in force: .
e. Finality. The decision of the City
Council shall be final."
SECTIdN 10: The City Clerk shall certify to the
adoption of this Ordinance by the-City Council of the City of
Lynwood,, and cause~the.same to be published in the manner
. . • prescribed by law.
