AN ORDINA1'lCE OF THE BOROUGH OF CARTERET
AUTHORIZING THE PREPARATION AND ISSUANCE OF BID
DOCUMENTS FOR THE LEASING OF A PORTION OF THE
MUNICIPAL ANNEX
WHEREAS, the Local Lands and Buildings Law, N.J.S.A. 40A:12-1 el seq., as
amended and supplemented (the "Act") authorizes municipalities to lease municipal real
property, capital improvements and personal property not otherwise needed for public
use; and
WHEREAS, the Borough has detemtined that the M\micipal Annex, located at
20 Cooke Avenue within the Borough, is currently underutilizecl; and
WHEREAS, the Borough desires to lease a portion of the Municipal Annex in
accordance with the Act.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED, by the Borough
Council of the Borough ofCarteret, Middlesex County, New Jersey, as follows:
Section 1. It is hereby found and detennined that the portion of the Municipal
Annex designated as "Leased Properti' as set forth in the form of Lease attached hereto
as Exhibit A is no longer needed for public use.

Section 2. Each of the Mayor, Chief Financial Officer and Director of Law
(each an "Authorized Officer"), in consultation with such counsel and other advisors to
the Borough, is hereby authorized to prepare such public bidding documents,
specifications and agreements as may be necessary, including without limitation, the
Lease, the form of which is attached hereto as Exhibit A. on such terms as the Authorized
Officer shall determine, all in accordance with the provisions of the Act.
Section 3. Each Authorized Officer is hereby authorized to publish, or cause
the Clerk of the Borough to publish, notice of the public bidding documents,
specifications and agreements referenced herein, in a newspaper of general circulation
within the Borough, all in accordance with the provisions of the Act.
Section 4. As set forth in the Act, the Borough reserves the right to reject any
and all bids where the highest bid is not accepted for any reason.
Section 5. This Ordinance shall take effect upon fmal passage and publication
in accordance with applicable law.
