ORDINANCE NO. 1389
~` AN ORDINANCE OF THE CITY OF LYNWOOD
PROHIBITING AGGRESSIVE SOLICITATION AND
AMENDING THE LYNWOOD MUNICIPAL CODE,
AND DECLARING THE URGENCY THEREOF
THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES ORDAIN AS FOLLOWS:

,Hereby•amended by~ad~~~ng thereto a new Section 3-22 which shall
read as follows::
"3-22. AGGRESSIVE SOLICITATION.
3-.22.1 No person shall coerce, threaten, hound, or
intimidate another person for the purpose of soliciting alms on
the street or at any cther place that is open to the public,
whether publicly or privately owned.
3-22.2. For purposes of this section, "soliciting" shall
mean asking for money or something of value, whether by words,
bodily gestures,. signs, or other means. For purposes of this
section "coerce, threaten, hound, or intimidate" shall mean that:
a. The sol~_citor's conduct causes a reasonable
solicitee to fear for his or her safety; or
b. The sci:icitor intentionally blocks the path of the
solicitee.; or

c. The solicitor follows the solicitee while the
solicitor demands money or something of value after the solicitee
informs the solicitor by words or conduct that the solicitee does
not desire to give the solicitor money or some other thing of
value to which the solicitor is not entitled under law."
Section ?.- The City Council finds and determines that
aggressive solicitations within the City are occurring with
alarming frequency, and that certain locations within the City,
whether publicly o~• privately owned,. are increasingly used for
these aggressive s:~licitations. Such activities expose the
residents of this rorlrlunity to criminal conduct and threaten
their health, welfare and safety. The City Council further finds
and determines that the immediate implementation of this
ordinance is Necessary and desirable in order to deter aggressive
solicitations and t:,o provide law enforcement agencies with
adequate authority to apprehend those persons engaged in such
conduct. Therefore, this ordinance is an urgency ordinance
necessary for the. immediate preservation of public peace, health
and safety within the meaning of Section 36937(b) of the
Government Code. and` shall 'take__ effect _immedi_atelv'.

_ Section 3. The City Clerk shall certify to the passage
and adoption of this ordinance and shall cause the same to be
published or posted in the manner required by law.
