HomeMy Public PortalAbout13-8688 Urging the State Legislature to Repeal the Stand Your Ground Law Sponsored by: Vice Mayor Kelley RESOLUTION NO. 13-8688 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA, URGING THE STATE LEGISLATURE TO REPEAL THE "STAND YOUR GROUND LAW"; PROVIDING FOR INCORPORATION OF RECITALS; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS,the "Stand Your Ground Law"was enacted in 2005, and signed into law by then Governor Jeb Bush; and WHEREAS, according to a study performed on the "Stand Your Ground Law", by Texas A&M University, states with such laws have more homicides than states without them; and WHEREAS,a new study has found justifiable homicides have skyrocketed,the rate is up 53 percent in 22 states, according to the study, and in Florida,the average annual rate is up 200 percent; and WHEREAS, in states that do not have the"Stand Your Ground Law",the rate has declined marginally; and WHEREAS, the City Commission of the City of Opa-locka wishes to urge the State Legislature to repeal the "Stand Your Ground Law". NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA LOCKA,FLORIDA: Section 1. The recitals to the preamble are hereby incorporated by reference. Section 2. The City Commission of the City of Opa-locka,urges the State Legislature to repeal the "Stand Your Ground Law". Section 3. The City Clerk shall provide a copy of this resolution to be sent to the State Legislature, the National League of Cities, and the membership of the Miami-Dade League of Cities. Section 4. This resolution shall take effect immediately upon adoption. PASSED AND ADOPTED this 25th day of September, 2013.
