HomeMy Public PortalAboutOrdinance NO. 461 Amending Chapter 2 Article 3 Section 8 Regarding Town Treasurer TOWN OF FRASER ORDINANCE NO. 461 SERIES OF 2018 AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 3 SECTION 80 OF THE FRASER MUNICIPAL CODE REGARDING TOWN TREASURER WHEREAS, The Fraser Town Code provisions related to the duties of Town Treasurer are out of date and staff recommends an update. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO, AS FOLLOWS: PART 1: AMENDMENT OF MUNICIPAL CODE Chapter 2 (Administration), Article 3 (Officers and Employees) of the Fraser Municipal Code (herein sometimes referred to as the "Municipal Code") is hereby amended as follows [Note: additions are shown in bold underlined print; deletions are shown as str,U gh print]: Sec. 2-3-80. - Town Treasurer. �- - - -e ee - - - ... •- -- - _ -- . • . - Constitution. If required by the Board of Trustees, the Town Treasurer shall furnish a surety duties as Town Treasurer so long as he or she shall serve as such Treasurer and requiring that, when he or she vacates such office, he or she will turn over and deliver to his or her successor all monies, books, papers, property or things belonging to the Town and requirement for such a bond. (b) Duties. The Town Treasurer shall: (1) Receive all monies belonging to the Town and shall keep his or her books and Trustees. belonging thereto. with the Town Clerk on the date of his or her monthly report. • _ _ - - - -- :e. _ . -- - -- - - • - -• - - - with all warrants redeemed and paid by him or her. Said warrants, with any vouchers her account in the Clerk's office upon every day of such statement. He or she shalt person to whom-and when paid. (5) Perform such other duties as may from time to time be assigned to the Town Treasurer by the Board of Trustees. (a) The Town Treasurer shall have the following duties: 1. To ensure an accurate and correct account of all funds and monies belonging to the Town and the disbursement thereof, and that such records are maintained in accordance with the Towns records management policies and open records regulations. Funds of the Town shall be kept in such bank or invested, as may be determined and directed by the Town Manager in accordance with the Towns Financial Policies. 2. To ensure such records as may be required to show all financial transactions of the Town, including such records as may be required by state statutes. 3. To ensure a full and complete financial report showing the cash condition and balances to the credit of each fund of the Town, once each month to the Town Board and at such other times as may be required by the Town Manager and/or Town Board. PART 2: REPEAL. Any and all existing ordinances or parts of ordinances of the Town of Fraser covering the same matters as embraced in this Ordinance are hereby repealed and all ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed; provided, however, that such repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this Ordinance. PART 3: SEVERABILITY. If any section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this Ordinance. The Town of Fraser hereby declares that it would have adopted this Ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases thereof be declared invalid or unconstitutional. PART 4: EFFECTIVE DATE. This Ordinance shall take effect thirty (30) days after passage, adoption and publication thereof as provided by law. PART 5: PUBLICATION.
