RESOLUTION N0. 75-22
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD RELATING TO THE DESTRUCTION OF ARREST RECORDS
WHEREAS, the Chief of Police of the City of Lynwood
has retained certain arrest records in the lawful execution
of his office which are no longer required; and
WHEREAS, Government Code §34090 permits the head of
a city department to destroy any city record, document, in-
strument, book or paper, under his charge, without making a
copy thereof, after the same is no longer required;
NOW, THEREFORE, the City Council of the City of Lyn-
wood hereby does find, determine, resolve and order as follows:
l. The records to be destroyed pursuant to this
Resolution do not include records the destruction of which is
specifically prohibited by Government Code ~34090 namely
(a) Records affecting the title to real
property or liens thereon;
(b) Court Records;
(c) Records required to be kept by statute;
(d) Records less than five years old;
(e) The minutes, ordinances, or resolutions
of the legislative body of the City of Lynwood.
2. The written consent of the City Attorney has
been obtained prior to the destruction of any and all city
records pursuant to this resolution.
3. The Chief of Police of the City of Lynwood is
hereby authorized to destroy all and any arrest records which
are no longer required with the exception of arrest records
of sex offenses, narcotics offenses (as dictated by Penal Code
~~851.7, 1203.4, 12~3.4a, 1203.45 and 851.7) misdemeanor

violations more than five years from the date of arrest and
felony violations more than seven years from the date of
arrest.
APPROVED AND ADOPTED this 1~3thday of March 1975.
