April 26, 1983
The Council of Bal Harbour Village met Tuesday, April 26, 1983, at 9:30
A.M. in the Village Hall.
Present: Messrs. Laikin, Printup, Sherman, Taplin and Mrs. Antiles.
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer,
Village Clerk; and Clifford Schulman, representing Alan S. Gold, Village Attorney.
On Motion of Mr. Taplin, seconded by Mr. Printup and voted the minutes of
April 18, 1983 were approved as submitted.
Mr. Maley introduced Messrs. Randy Ramon and William O'Leary, representing
a joint venture of the firms, of Douglas Ruth and William O'Leary, Landscape
Architects. Mr. O'Leary gave a brief review of some of the work done by his firm
for the City of Miami, and the City of Miami Beach. He also had a slide pre-
sentation of his work. After the interview it was the decision of the council
that Mr. Maley should visit the firms beingconsidered and report back to the
council at the next meeting. Mr. Dee of Edward D. Stone Associates said that due
to the crowded room at the last meeting he had not gone into detail regarding
their scope of work and would like an opportunity to address the council again
at the next meeting. Mr. Sherman told Mr. Dee he would be welcome to appear.
Mr. Maley said that he and Mr. Gold had negotiated with the Gannett news-
paper representatives and they had reduced the number of USA Today newsracks
from 22 to 11. Mr. Schulman read Mr. Gold's letter to the council in which he
recommended that the proposed ordinance governing newsracks be tabled as long
as we had accomplished the same thing by negctiation with Gannett publications
and other newspapers in the area. Mr. Maley said that the full compliance with
the ordinance would reduce the USA Today racks to nine. Miss Snyder, attorney
for the Gannett publishers said she would guarantee full compliance by re-
ducing the number to nine today. It was moved by Mr. Taplin, seconded by Mrs.
Antiles and voted that Proposed Ordinance No. 250, regulating newsracks in
the village be tabled.
The Council reviewed the six months operating statements and Mr. Maley
explained the statements and our method of expenditures. It was moved by Mr.
Taplin, seconded by Mr. Printup and voted that the statements be filed for audit.
Mr. Sherman advised that copies of the statements could be obtained on request
at the village hall.
Mr. Sherman commented that the local Post Office in Surfside is in bad
repair. The Mayors of Surfside and Bay Harbor Islands agree with him that the
Post Office should be refurbished. Mr. Maley said that until recently, Frasuer
Knight, the architect for our public works facility had the architectual
contract with the Post Office for repairs and updating of local offices.
Mr. Knight advised him on whom to contact. It was moved by Mr. Printup,
seconded by Mr. Taplin and voted that the village attorney prepare a resolution
urging the U. S. Postal Service to improve the Surfside Branch.
Mr. Sherman asked Mr. Maley to explain our water situation due to the
recent bacteria problem in the water from Miami Beach. Mr. Maley explained
that we still have a connection to the City of North Miami Beach which could
be used for an emergency. He explained that the City of North Miami Beach had
recently used water from our system, with the approval of our suppliers, by
reversing the meter at the north end of the village. It would take at least one

day to reverse the flow again.
Mr. Printup left the meeting at this time.
Mr. Taplin said that he thought the village should give a gift to Mr.
Beatty in appreciation of his years of service as councilman and mayor. Mr.
Maley said this was being taken care of and that Mr. Beatty had requested
that nothing be presented to him until later.
Mr. Ralph Gimel of the Bal Harbour Resort Association reported that Mr.
Maley had made a common-sense presentation to our legislators in Tallahassee
regarding the proposed super tourism agency. He reviewed the status of another
bill in the Legislature which would allow a referendum in Miami Beach for an
additional 2% Resort Tax for the Convention Hall expansion. Mr. Maley said
that it was suggested that a meeting be called of the elected officials of the
county and the cities generating the Resort Tax to see if an interlocal agree-
ment could be worked out. Mr. Maley reviewed our council's opinion that the
main convention center should remain on Miami Beach and that some method of
transportation is needed between Miami Beach and Miami.
Mr. Schulman told the council he had a proposed resolution for the
council's consideration. Mr. Schulman read
Resolution No. 283
regarding the disrepair of the Surfside Post Office and urging the United States
Postal Service to refurbish the site. On motion of Mr. Taplin, seconded by
Mrs. Antiles and voted the Resolution was adopted.
On motion of Mr. Taplin, seconded by Mr. Laikin and voted the meeting
was adjourned at 11:30 A.M.
