HomeMy Public PortalAboutOrd. 1419CITY OF LYNWOOD LOS ANGELES COUNTY, CALIFORNIA ORDINANCE NO. , 141g AN ORDINANCE OF THE CITY OF LYNWOOD AMENDING URGENCY ORDINANCE NO. 1416._.;WHICH IMPOSES A MORATORIUM ON THE ESTABLISHMENT OR EXPANSION OF CERTAIN AUTOMOTIVE USES WITHIN ALL LAND USE ZONES OF THE CITY,, EXTENDING THAT MORATORIUM TO JULY 5, 1996, AND DECLARING THE URGENCY THEREOF 'THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES ORDAIN AS ..­FOLLO -WS.— Section 1. Section 2 of Ordinance No. 1416 is amended in its entirety to read as follows: " Section 2 . The moratorium established in Section 1 above does not apply to the following: 1 (a) The construction.of buildings or structures for which all permits have been obtained as of the effective date of this interim ordinance. (b) The processing and approval'by the Lynwood Redevelopment Agency of any project involving a new or expanded automotive use where the governing board of the Agency has made a determination that the project will substantially advance the goals and objectives of the redevelopment process and will contribute towards the elimination of blight in a redevelopment project area." Section 2. In accordance with Government Code Section 65858(d), the City Council did,-on August 8, 1995, issue a written report describing the measures taken to alieviate the conditions which led to the adoption of Ordinance No. 1416 and thereafter conducted,a noticed public hearing as required by Government Code Section 65858(a). In, accordance with applicable law, Ordinance No. 1416 is extended for a period of ten months and 15 days to July 5, 1996, and shall thereupon be of no further force and effect. Section 3. The City Council, the Planning Commission and the Department of Community Development are continuing to study various measures to alleviate the conditions which led to the - adoption of Ordinance No'. 1416, which conditions are recited in Section -A of Ordinance No. 1416 and which continue to pose a current threat to the public health, safety and welfare. This Ordinance extending Ordinance No. 1416 will ensure that no approvals or entitlements for automotive uses will be granted under the zoning ordinance or other ordinances so as to conflict with future zoning regulations now under consideration and study. Section 4. The City Council incorporates by this reference the findings set forth in Section 4 of Ordinance Nd - 1416 - a -rnd further'determines that this Ordinance extending _- Ordinance No. 1416 is necessary to prevent a current and 950808 10512- 00001'syc 0592190 0 t immediate threat to the public health, safety and welfare. This Ordinance is an urgency ordinance and shall take effect immediately.
