HomeMy Public PortalAbout75-052 (06-03-75)RESOLUTION NO. 75-52 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING AND DIRECTING THE CONDEMNATION OF CERTAIN REAL PROPERTIES IN THE COUNTY OF LOS ANGELES, STATE OF CALIFORNIA AND DECLARING THE PUBLIC NECESSITY THEREFOR WHEREAS, the City of Lynwood is authorized by virtue of the Statutes of the State of California to take property by condemnation and to hold, use and enjoy said property as necessary to the full exercise of its power, NOW, THEREFORE, the City Council of the City of Lynwood hereby does resolve as follows: SECTION 1. The City Council of the City of Lynwood has found and determined and does hereby find and determine that the public interest and necessity require for public use the acquisition, construction, completion, operation and maintenance by said City of Lynwood of certain public improvements, to wit ;easements for street right-of-way purposes, and that certain real properties situated in the City of Lynwood, County of Los Angeles, State of California, are necessary therefor. SECTION 2. The real properties, the acquisition of which is required for the public interest and necessity for the uses and purposes set forth in Section 1 hereof, are situated in the City of Lynwood, County of Los Angeles, State of California, and are more particularly described as follows: Parcel 2:(Long Beach Boulevard Phase III) The northeasterly 10.00 feet, measured at right angles of lot 2 of Tract No. 2794, in the City of Lynwood, in the county of Los Angeles, state of California, as per map recorded in book 28 page 6 of Maps, in the office of the county recorder of said county. Parcel 3: (Long Beach Boulevard Phase III) The northeasterly 10, 00 feet, measured at right angles, of lot 3 of Tract No, 2794, in the City of Lynwood, county of Los Angeles, state of California, as per map recorded in book 28 page 6 of Maps, in the office of the county recorder of said county. Parcel 40 (Long Beach Boulevard Phase III) The northeasterly l00 00 feet, measured at right angles of Lot 4 of Tract Noo 2794, in the City of Lynwood, in the county of Los Angeles, state of California, as per map recorded in book 28 page 6 of Mpas, in the office of the county recorder of said county. Parcel 5~ (Long Beach Boulevard Phase III) The northeasterly l00 00 feet, measured at right angles, of Lot 5 of Tract No. 2794, in the City of Lynwood, in the county of Los Angeles, state of California, as per map recorded in book 28 page 6 of. Maps, in the office of the county recorder of said countyo Parcel 6: (Long Beach Boulevard Phase III) The northeasterly 10, 00 feet , measured at right angles, of Lot 6 of Tract Noo 2794, in the City of Lynwood, in the county of Los Angeles, state of California, as per map recorded in book 28 page 6 of Maps, in the office of the county recorder of said countyo EXCEPT the southerly 50 feet measured along the west line of said loto Parcel 19: (Long Beach Boulevard Phase III) That portion of Lot 38 of Tract No, 2551, in the City of Lynwood, County of Los Angeles, State of California, as per map recorded in book 24 page 78 of Maps, in the office of the Bounty recorder of said county described as followse Beginning at the most easterly corner of said Lota thence west- erly along the southerly line of said lot to the westerly line of the easterly l00 00 feet, measured at right angles of said lot and the true point of beginning; thence continuing, westerly along said southerly line to a point that is distant easterly, thereon, 16062 feet from the southwesterly corner of said lot; thence northerly, at right angles to said southerly line, to the northerly line of the southerly 7, 00 feet, measured at right angles, of said lot; thence Easterly, along said northerly line to the beginning of a tangent curve concave northwesterly, and having a radius of 27o 00 feet; thence easterly along said curve to said westerly line of the easterly 10~ 00 feet of said lot; thence southerly along said westerly line to the true point of beginning. Parcel 250 (Long Beach Boulevard Phase III) The westerly 90 5 feet (measured at right angles) of Lots 28 and 29 of Tract Noo 2551, in the City of Lynwood, county of Los Angeles, state of California, as per map recorded in book 24 pages 78 to 80 of Maps, in the office of the county reoorder of said county, Parcel 30; (Long Beach Boulevard Phase III) The westerly 10 feet (measured at right angles) of the northwesterly 50 feet of Lot 8 of Tract No. 2794, in the City of Lynwood, county of Los Angeles, state of California as per map recorded in book 28 page 6 of Maps, in the office of the county recorder of said county, Parcel 32A: (Long Beach Boulevard Phase III) The westerly 6, 5 feet (measured at right angles) of Lot 10 of Tract No. 2794, in the City of Lynwood, county of Los Angeles, state of California, as per map recorded in book 28 page 6 of Maps, in the office of the county recorder of said county. Parcel 32B: (Long Beach Boulevard Phase III) That portion of Lot 11 of Tract No. 2794, in the City of Lynwood, county of Los Angeles, state of California, as per map recorded in book 28 pages 6 of Maps, in the office of the county recorder of said county, described as follows: Beginning at the southwest corner of said lot; thence northerly along said westerly line of said lot to the northwest corner thereof; thence easterly along the northerly line of said lot to a line that is parallel with and distant easterly 10 feet (measured at right angles) from said westerly line of Lot 11; thence southerly along said parallel line to the beginning of a tangent curve concave northeasterly having a radius of 17 feet, said curve also being tangent at its southerly terminus to the southerly line of said lot; thence southerly along said curve to said point of tangency in said southerly line; thence westerly along said southerly line to the point of beginning. SECTION 3, Said public improvement is planned and located in the manner which will be most compatible with the greatest public good and the least private injury, SECTION 4o The law firm of Rutan and Tucker, attorneys for the City of Lynwood, is hereby directed to brim action in the Superior Court of the State of California in the name of the City of Lynwood, to condemn for eminent domain proceedings the properties described in Section 2 hereof. Said attorneys are authorized and instructed to make application to said Court for an Order fixing the amount of security by way of money deposits as said Court may direct and for an Order permitting the City of Lynwood to take possession and use of said real properties for the uses and purposes herein described, SECTION 5, For the purposes of bringing such action, the firm of Rutan and Tucker is hereby empowered to incur, in the name of the City of Lynwood, all obligations and expenses incidental thereto.
