HomeMy Public PortalAbout1994-022Member James Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 94-22 RESOLUTION GRANTING CONDITIONAL USE PERMIT FOR MICHAEL SPOHN WHEREAS, Michael Spohn (Applicant) has requested a conditional use permit for an auto repair business at the property located at 2162 T . H . 55 ; and WHEREAS, use of the property as requested by the Applicant requires a conditional use permit under the city's zoning ordinance; and WHEREAS, the planning commission reviewed the request on March 8, 1994, and the city council reviewed the matter on April 5, 1994; and WHEREAS, the city council has determined that the proposed use would not interfere with the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be issued to Michael Spohn for an auto repair business at 2162 T.H. 55, subject to the following: 1. Hours of operation shall not exceed noon to 10 p.m. , 7 days per week; 2. The number of persons employed on the property shall not exceed one; 3. There shall be no outside speaker or telephone bell; 4. Excluding the Applicant's personal vehicles, there shall be no more than two vehicles stored outside on the site for repair; 5. The Applicant shall dispose of all hazardous waste properly and he shall file with the City a disposal plan which is in accordance with the standards of the MnTap or Hennepin County; 6. There shall be no outside storage allowed on the site; 7. Any exterior signs shall meet all relevant city codes; 8. All mechanical equipment, heating, exists and fire extinguishers shall be reviewed by the fire marshall; RBB68395 ME230-203 9. There will be space available on the site for eight parked cars; 10. The driveway and parking area shall remain rock and gravel; 11. The terms and conditions of this permit are subject to annual review. The city reserves the right, upon future review, to require that the driveway be hard surfaced if the business increases in volume or if there exists any violations of the terms and conditions of this permit; and 12. The Applicant shall pay to the City the administration fee required by the city to compensate if for the review of this application. Dated: April 19 , 1994. Anne E.
